Metropolitan Council Meeting

Tuesday, July 20, 1999


The Metropolitan Council met in regular session on this date at 7:00 p.m. in the Metropolitan Courthouse.

The invocation was offered by Councilmember Ron Nollner.

The Metropolitan Council gave the pledge of allegiance to the American Flag.

Without objection the following legislation relating to the Dell Computer Corporation proposal was considered: SR99-1582, R99-1587, R99-1621, SO99-1679, O99-1680, SO99-1681, O99-1763.

SUBSTITUTE RESOLUTION NO. SR99-1582

A substitute resolution authorizing the issuance of not to exceed Nine Million Seven Hundred Fifty Thousand Dollars ($9,750,000) in aggregate principal amount of general obligation bond anticipation notes of The Metropolitan Government of Nashville and Davidson County; making provision for the issuance, sale and payment of said notes, and authorizing the expenditure of proceeds thereof. The resolution was approved by the Budget and Finance Committee.

RESOLUTION NO. R99-1587

A resolution authorizing the transfer of certain property of The Metropolitan Government of Nashville and Davidson County to the Industrial Development Board of The Metropolitan Government of Nashville and Davidson County. The resolution was approved by the Budget and Finance Committee.

RESOLUTION NO. R99-1621

A resolution approving an Economic and Community Development Incentive Grant and the Economic and Community Development Incentive Grant Agreement between The Metropolitan Government of Nashville and Davidson County, The Industrial Development Board of The Metropolitan Government of Nashville and Davidson County and Dell Computer Corporation. The resolution was approved by the Budget and Finance Committee.

SUBSTITUTE BILL NO. SO99-1679

An ordinance authorizing the Industrial Development Board of The Metropolitan Government of Nashville and Davidson County to negotiate and accept payments in lieu of ad valorem taxes with respect to the Dell Computer Corporation Project. The substitute bill was approved by the Budget and Finance Committee.

BILL NO. O99-1680

An ordinance amending Title 2 of the Metropolitan Code of Laws to establish an Economic and Community Development Incentive Program. The bill was approved by the Budget and Finance Committee.

SECOND SUBSTITUTE BILL NO. SO99-1681

A substitute ordinance conveying certain right-of-way to the Metropolitan Nashville Airport Authority, retaining certain easements and amending the Official Street and Alley Acceptance and Maintenance Map for The Metropolitan Government of Nashville and Davidson County, by closing certain rights-of-way (Proposal No. 99M-075U), all of which is more particularly described herein. The substitute bill was approved by the Planning Commission, Traffic and Parking Commission, Budget and Finance, Public Works, Rules-Confirmations-Public Elections-Aviation and Planning, Zoning, Historical and Port Authority Committees.

BILL NO. O99-1763

An ordinance approving the Central State Redevelopment Plan. The bill was approved by the Planning Commission, Federal Grants Review and Planning, Zoning, Historical and Port Authority Committees.

Mr. Fentress moved to adopt Substitute Resolution No. SR99-1582, Resolution No. R99-1587, Resolution No. R99-1621 and to pass on third reading Substitute Bill No. O99-1679, Bill No. O99-1680, Second Substitute Bill No. O99-1681, and Bill No. O99-1763, which motion was seconded. Mr. Majors moved to take from the table three previously-offered amendments to Bill Nos. O99-1679 and O99-1680, but objection was made to the motion. After discussion, Mr. Hall called for the previous question, which motion was seconded and adopted by a roll call vote of the Council. Without objection, Bill No. O99-1697 relating to the Dell Computer Corporation proposal was considered at this time:

An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by changing from AR2a District to IR District properties at Murfreesboro Pike (unnumbered) and Couchville Pike (unnumbered), north of McGavock Pike, Donelson Pike (unnumbered) and east of Donelson Pike (677.69 acres), (Proposal No. 99Z-080U), all of which is more particularly described herein. The bill was approved by the Planning Commission and Planning, Zoning, Historical and Port Authority Committee. Ms. Sontany moved to pass the bill on third reading, which motion was seconded. After discussion, Mr. Clifton moved to defer the motion, which motion was seconded. Mr. French moved to table the motion to defer, which motion was seconded and adopted by a roll call vote of the Council. After further discussion, Mr. Fentress called for the previous question, which motion was seconded and adopted without objection. RESOLUTION NO. R99-1593

A resolution appropriating the amount of $ 3,174,500 from the General Fund Reserve Fund for the purchase of equipment, and for making repairs to buildings for various departments of The Metropolitan Government of Nashville and Davidson County. The resolution was approved by the Budget and Finance; Health, Hospitals and Social Services; Parks, Library, Recreation and Auditorium, Public Safety-Beer, Wine and Whiskey and Public Works Committees. RESOLUTION NO. R99-1596

A resolution approving a contract by and between the Metropolitan Government and Waste Management, Inc., for collection of residential curbside recycling materials in the Urban Services District. The resolution was approved by the Budget and Finance Committee and the Public Works Committee recommended deferment. Mr. Fentress moved to defer action on the resolution, which motion was seconded and adopted by a voice vote of the Council.

RESOLUTION NO. R99-1609

A resolution requesting the Public Library Board to name the new main Public Library in honor of Mayor Philip N. Bredesen. Mr. Stanley requested permission to withdraw the resolution at the request of the Administration, which permission was granted by the unanimous vote of the Council.

RESOLUTION NO. R99-1610

A resolution authorizing the Director of Public Property to exercise an option to purchase real property (Map 173, Parcel 45 - Blue Hole Road) on which to construct a new elementary school. The resolution was approved by the Planning Commission, Budget and Finance, Education and Planning, Zoning, Historical and Port Authority Committees. RESOLUTION NO. R99-1611

A resolution requesting the Metropolitan Board of Public Education to name one of the new school facilities in honor of Vic Varallo. The resolution was approved by the Rules-Confirmations-Public Elections-Aviation Committee with an amendment; the Education Committee recommended indefinite deferment. Mr. Crafton moved to defer the resolution, which motion was seconded and adopted by a voice vote of the Council.

RESOLUTION NO. R99-1612

A resolution requesting the Metropolitan Public Library Board to consider installing filters on Internet access to screen out pornographic materials. The Rules-Confirmations-Public Elections-Aviation Committee approved the resolution with an amendment. Ms. Arriola offered Amendment No. 1 and moved for its adoption, which motion was seconded and adopted by a voice vote of the Council. RESOLUTION NO. R99-1613

A resolution requesting the Metropolitan Board of Health to adopt swimming pool regulations that would be the same as the state regulations and less restrictive than present regulations. The Rules-Confirmations-Public Elections-Aviation Committee recommended indefinite deferment. Ms. Arriola moved to defer action indefinitely on the resolution, which motion was seconded and adopted by a voice vote of the Council.

RESOLUTION NO. R99-1614

A resolution requesting the Davidson County delegation to the Tennessee General Assembly to enact necessary legislation to allow recall provisions of the Metropolitan Charter to be applicable in the area of the Metropolitan Government. The Rules-Confirmations-Public Elections-Aviation Committee recommended deferment of the resolution. Mr. Johns moved to defer action on the resolution, which motion was seconded and adopted by a voice vote of the Council.

RESOLUTION NO. R99-1615

A resolution requesting the Department of Public Works to discontinue recycling until the new program for recycling in the Urban Service District is implemented. The Rules-Confirmations-Public Elections-Aviation Committee recommended deferment of the resolution. Mr. Majors moved to defer action on the resolution and refer it to the Public Works Committee, which motion was seconded and adopted by a voice vote of the Council.

RESOLUTION NO. R99-1616

A resolution expressing the support of the Metropolitan Council to the plan for curbside recycling throughout the Urban Services District of The Metropolitan Government of Nashville and Davidson County . The Public Works Committee recommended deferment of the resolution. Mr. Ferrell moved to defer action on the resolution, which motion was seconded and adopted by a voice vote of the Council.

RESOLUTION NO. R99-1617
