SUBSTITUTE ORDINANCE NO. SO99-1787

A substitute ordinance to amend the Official Street and Alley Acceptance and Maintenance Map for the Metropolitan Government of Nashville and Davidson County, by closing one foot portion of Alley No. 74 extending from Church Street southward for 324 feet, and constructing a 3' 7" sidewalk within the alley for pedestrian safety, reducing the alley's present 14' 0" width to 10' 0", (Proposal No. 99M-083U), all of which is more particularly described herein.

WHEREAS: It is the desire of all the abutting property owners that said closure be accomplished; and,

WHEREAS: There is no future need for said portion of Alley No. 74 for alley purposes.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

SECTION 1. That the Official Street and Alley Acceptance and Maintenance Map for The Metropolitan Government of Nashville and Davidson County, as enacted by Ordinance No. O98-1473, be and is hereby amended, as follows:

That a one foot portion of Alley No. 74 extending from Church Street southward for 324 feet, and the construction of a 3' 7" sidewalk within the alley for pedestrian safety, reducing the alley's present 14' 0" width to 10' 0", between Church Street and Commerce Street, all of which is more particularly described by lines, words and figures on the sketch which is attached to and made a part of this ordinance as though copied herein, is hereby closed.

SECTION 2. BE IT FURTHER ENACTED, That the Director of the Department of Public Works be and is hereby authorized and directed, upon the enactment and approval of this ordinance, to cause said change to be made on said Map as set out in Section 1 of this ordinance, and to make notation thereon of reference to the date of passage and approval of this amendatory ordinance.

SECTION 3. BE IT FURTHER ENACTED, That this ordinance take effect from and after its passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.

AMENDMENT NO. 1

TO

ORDINANCE NO. SO99-1787

Mr. President:

I move to amend Ordinance No. SO99-1787 by inserting after Section 1 a new Section 2, as described below, and renumbering the other sections of the said ordinance appropriately.

Section 2. BE IT FURTHER ENACTED, THAT the abandonment of easements shall only occur with the one foot portion of Alley No. 74 to be closed. Easements are to be retained in the remaining 13 feet of the alley, including those that may lie beneath the proposed sidewalk.
