ORDINANCE NO. O99-1684
An ordinance approving a real property lease agreement between Norman W. Ginsberg and the Metropolitan Government of Nashville and Davidson County by and through the Metropolitan Board of Education for use as warehouse space for the surplus property Reuse-Recycle-Disposal Center at 101 Spence Lane.
Whereas, the Metropolitan Board of Education has approved the entry into an agreement with Norman W. Ginsberg to lease certain property located at 101 Spence Lane for use as the schools' surplus property Reuse-Recycle-Disposal Center; and
Whereas, the schools' Reuse-Recycle-Disposal Center houses the fixed assets department that operates the Reuse-Recycle-Disposal program, which gathers surplus property from various departments (including schools) and makes the property available to other Metro departments before conducting price tag sales and auctions; and
Whereas, the power of the Metropolitan Board of Education to acquire real property is limited by Metropolitan Charter Section 9.14, which vests title to all school property in the Metropolitan Government; and
Whereas, the Metropolitan Council desires to enter into a lease for the schools' surplus property Reuse-Recycle-Disposal Center has been negotiated with Norman W. Ginsberg for the benefit of the Metropolitan Government.
Now, therefore, be it enacted by the Council of The Metropolitan Government of Nashville and Davidson County.
Section 1. That the Lease Agreement between Norman W. Ginsberg and The Metropolitan Government of Nashville and Davidson County by and through the Metropolitan Board of Education for premises at 101 Spence Lane, Nashville, Tennessee, for use as the schools' Reuse-Recycle-Disposal Center for rent of three thousand six hundred sixty dollars ($3360) per month and for a term commencing upon January 1, 1998, and extending through December 31, 1999, with provision for a month-to-month tenancy in the event the lessee remains in possession of the premises beyond the termination date, which lease is attached hereto by reference, is hereby approved and the Metropolitan Mayor is hereby authorized to execute said lease.
Section 2. That any amendment to the Lease Agreement approved herein may be approved by resolution of the Metropolitan Council
Section 3. That this ordinance shall take effect from and after its passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
