ORDINANCE NO. O99-1806

An ordinance granting the Planning Commission the authority to administratively correct the zoning maps where evidence exists that a property’s zone classification is incorrectly depicted on the zoning maps due to digitizing mapping errors and the evidence supports that there was never any intent to effectuate a zone change for such property.

Whereas, Substitute Ordinance No. SO96-555 enacted a new comprehensive zoning code; and

Whereas, the comprehensive rewrite of the zoning code required that the zoning maps be revised to reflect the changes in the comprehensive rezoning; and

Whereas, in revising the zoning maps certain properties which were never intended to be rezoned, nevertheless are now depicted on the zoning maps as a different zoning classification due to digitizing mapping errors; and

Whereas, it is in the best interest of the citizens of The Metropolitan Nashville and Davidson County to permit the planning commission to administratively correct digitizing errors depicted in the zoning maps under circumstances where the planning commission has evidence that property is currently depicted on the zoning maps under a different zoning classification than such property was zoned prior to the enactment of the comprehensive zoning code in 1997 and there was never any intent for such property to be rezoned; and

Now, therefore, be it enacted by the Council of The Metropolitan Government of Nashville and Davidson County:

Section 1: That the planning commission is authorized to administratively correct the zoning maps where evidence exists that a property’s zone classification is incorrectly depicted on the zoning maps due to digitizing errors which may have occurred when Substitute Ordinance No. SO96-555 was enacted and, where there is no evidence to indicate that such property was to be rezoned.

Section 2 : This Ordinance shall take effect from and after its passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
