ORDINANCE NO. O99-1764

An ordinance authorizing The Metropolitan Government of Nashville and Davidson County to enter into a Memorandum of Understanding with Averitt Properties, Inc. of Tennessee concerning disposition of certain property and relocation of the Metropolitan Government’s salt storage facility.

Whereas, The Metropolitan Government of Nashville and Davidson County (hereinafter "the Metropolitan Government") is the owner of certain real estate located at Interstate 24 and Briley Parkway (Tax Map 119-16 Parcel 17) in Nashville, Davidson County, Tennessee ; and

Whereas, Averitt Properties, Inc., a Tennessee corporation (hereinafter "Averitt") is the owner of certain real estate (Tax Map 119-16, Parcel 91) contiguous to said Metropolitan Government property; and

Whereas, Averitt desires to acquire a portion of the above described property of the Metropolitan Government for the purpose of expanding its existing site; and

Whereas, the Metropolitan Government’s existing salt storage facility is located on its property at this location; and

Whereas, it is in the best interest of the Metropolitan Government to enter into an agreement pursuant to which in exchange for acquiring a portion of the Metropolitan Government’s property Averitt will bear the expense and risk of relocating the salt storage facility to another suitable location,

Now, therefore, be it enacted by the Council of The Metropolitan Government of Nashville and Davidson County:

Section 1. The Memorandum of Understanding attached hereto as Exhibit 1 is hereby approved and the Metropolitan Mayor is authorized to execute same on behalf of the Metropolitan Government.

Section 2. That this Ordinance shall take effect from and after its passage, the welfare of the Metropolitan Government of Nashville and Davidson County requiring it.
