ORDINANCE NO. O99-1816

An ordinance authorizing the Metropolitan Government of Nashville and Davidson County to enter into a contract with the State of Tennessee for reimbursement of funds expended for litter pickup using inmate labor.

Whereas, Tennessee Code Annotated, Section 41-2-123, provides that the Commissioner of Transportation is authorized to make grants to the several counties of the State for the purpose of funding programs for the collection of litter and trash along the county, state and interstate roads and highways within the respective counties, by inmate labor; and

Whereas, the State of Tennessee, Department of Transportation, has awarded Grant No. CHB781 in an amount not to exceed two hundred five thousand twenty three dollars ($205,023) to the Metropolitan Government of Nashville and Davidson County, for reimbursement of funds expended for litter and trash pickup using inmate labor within Davidson County; and

Whereas, the Metropolitan Government is required under said grant contract to provide matching funds in the amount of sixty one thousand five hundred dollars ($61,500); and

Whereas, it is to the benefit of the citizens of the Metropolitan Government of Nashville and Davidson County that this grant be accepted.

Now, therefore, be it enacted by The Council of The Metropolitan Government of Nashville and Davidson County:

Section 1: That the attached contract between the State of Tennessee by and for its Department of Transportation and the Metropolitan Government of Nashville and Davidson County, pursuant to Tennessee Code Annotated § 41-2-123, for a grant which utilizes inmate labor for litter and trash pickup along certain routes within Davidson County in an amount not to exceed two hundred five thousand twenty three dollars ($205,023) is hereby approved, and the Mayor is authorized to execute same.

Section 2: That the sum of sixty one thousand five hundred dollars ($61,500) be provided for the purpose of providing the Metropolitan Government’s matching share for the program.

Section 3. That any amendments to this grant shall be approved by resolution of the Metropolitan Council receiving at least twenty-one affirmative votes.

Section 4: That this Ordinance shall take effect from and after its enactment, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
