ORDINANCE NO. O99-1754

AN ORDINANCE TO AMEND VARIOUS SECTIONS OF TITLE 17 OF THE METROPOLITAN CODE OF LAWS, THE ZONING CODE, ALL OF WHICH IS MORE PARTICULARLY DESCRIBED HEREIN.

WHEREAS, Substitute Ordinance No. S096-555 enacted a new comprehensive zoning code (Title 17 of the Metropolitan Code of Laws); and

WHEREAS, the Metropolitan Government of Nashville, and Davidson County has monitored the effectiveness of the new code to implement the general plan and protect the health, safety and general welfare of the community; and

WHEREAS, it is now in the best interest of the citizens of Metropolitan Nashville, and Davidson County to amend selected provisions of that new zoning code so as to better implement the general plan and protect the public health, safety and general welfare of the community; and

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE, AND DAVIDSON COUNTY.

SECTION 1. Section 17.04.060. (Definitions of general terms) shall be amended by amending the definition of "outpatient clinic" to read as follows:

"Outpatient clinic means a facility for examining and treating patients with medical problems on an outpatient basis, including ambulatory care or similar medical services that generally require a stay of less than 24 hours."

SECTION 2. Section 17.04.060. (Definitions of general terms) shall be amended by adding the following new definition therein:

"Personal care services means services such as fitness centers, spas, tanning salons, beauty and barber care, and dry cleaning and laundry services not to include a laundry plant."

SECTION 3. Section 17.04.060. (Definitions of general terms) shall be amended by revising the definition of "distributive business/wholesale" to read as follows:

"Distributive business/wholesale means the sale or distribution of goods from the premises that may consist of the flexible use of the floor area for warehouse, assembly, showroom and office space within tenant areas, with the showroom and office area not exceeding fifty percent (50%) of the total floor area permitted on the parcel.:

SECTION 4. Section 17.08.030 (District land use tables) shall be amended by inserting a "P" in the table under Personal Care Services" in the "IWD" and "IR" districts.

SECTION 5. Section 17.12.060 (special floor area ratio (FAR) provisions) Item D shall be amended by deleting the word "required" as it appears twice in the sentence, and adding the following phrase to the end of the sentence:

"when such spaces or berths are used to satisfy the parking demands for the principal use(s) on the parcel."

SECTION 6. Section 17.24.030. (Exceptions) Item C, shall be amended by amending the first sentence to read as follows:

"c. A platted lot zoned for single-family or two-family dwellings for which a valid building permit has been issued."

SECTION 7. This ordinance shall take effect five days from and after its passage upon publication of the caption and a summary of the ordinance in a newspaper of general circulation in Metropolitan Nashville, and Davidson County, the welfare of the Metropolitan Government of Nashville and Davidson County requiring it.

Mr. President:

I move to amend Ordinance No. O99-1754 by deleting Section 4 in its entirety, and renumbering the succeeding sections accordingly.
