ORDINANCE NO. O99-1765
An ordinance approving a lease agreement between The Metropolitan Government of Nashville and Davidson County and the State of Tennessee for operation of a medical examiners office.
Whereas, The Metropolitan Government of Nashville and Davidson County (the "Metropolitan Government") presently operates a medical examiners office through a privatization contract on the former General Hospital complex at the Forensic Sciences Center; and
Whereas, the Forensic Sciences Center is technologically and functionally obsolete for use as a medical examiners office; and
Whereas, the Metropolitan Development and Housing Agency is developing the former General Hospital complex as part of the Rolling Mill Hill Project, thus necessitating the need to relocate various Metropolitan Government departments, which includes the medical examiners office; and
Whereas, the State of Tennessee desires to build a medical examiner facility to assist county medical examiners offices with their performance of autopsies; and
Whereas, the State of Tennessee has agreed to build a medical examiners facility for the state medical examiners office, which will be financed by the issuance of State of Tennessee bonds; and
Whereas, the medical examiner facility to be built by the State of Tennessee will be located in Davidson County; and
Whereas, the Metropolitan Government is currently in need of procuring through lease or acquisition suitable space to operate a medical examiners office; and
Whereas, the State of Tennessee desires to enter into a lease agreement ("Lease") with the Metropolitan Government that will allow the Metropolitan Government to relocate the Metropolitan Governments medical examiners office to a modern and state of the art facility.
Now, therefore, be it enacted by the Council of The Metropolitan Government of Nashville and Davidson County:
Section 1. The Lease between The Metropolitan Government of Nashville and Davidson County and the State of Tennessee, which is attached hereto and incorporated by reference, is hereby approved and the Metropolitan County Mayor is authorized to execute the lease on behalf of the Metropolitan Government.
Section 2. Any further amendment to the Lease between the Metropolitan Government and the State of Tennessee must be approved by resolution of the Metropolitan Council that receives at least 21 affirmative votes.
section 3. This ordinance shall take effect from and after its passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.

Amendment No. 1 to Ordinance No. O99-1765
Mr. President:
I hereby move to amend Ordinance No. O99-1765 as follows:
1. The Lease Agreement is hereby amended by adding the following additional language to the end of Paragraph 5:
The parties hereto agree that Lessee shall not, at any time hereunder, be in default of this Lease by virtue of any default of any contracts, contemplated by this Paragraph 5, between the pathologists or group of pathologists employed by or under contract with the Metropolitan Government and counties outside of Davidson County.
2. The Lease is amended by adding a description of the premises as Attachment A and a Needs Assessment, dated August 3, 1998, as Attachment B.
3. Except as otherwise specifically set forth in this Amendment, the Lease remains in full force and effect, without modification, amendment or change.
