ORDINANCE NO. O99-1781

An ordinance authorizing the Metropolitan Government to enter into Utility Contract No. 5424 with the State of Tennessee, Department o f Transportation, for the construction of certain utilities, said construction being necessary as part of State Project No. CM-STP-l 1(23), 19028-2233-54 involving SR-1 I (Nolensville Rd.) with Tusculum Rd. Intersection (Metro Project Nos. 98-SG-175 & 98-WG120).

WHEREAS, in order for the Tennessee Department of Transportation to construct State Project CM-STP-11(23), 19028-2233-54 involving construction of SR-11 (Nolensville Rd.) with Tusculum Rd. Intersection, it is necessary to adjust or construct certain water lines and/or sewer lines; and

WHEREAS, the estimated cost for the adjustment or construction of the water and/or sewer lines or facilities to the Department of Water and Sewerage Services is $16,682.60, said amount to be used to reimburse the Tennessee Department of Transportation; and

WHEREAS, the Tennessee Department of Transportation desires to start construction of said project and has submitted Utility Contract No. 5424, attached hereto as Exhibit A and made a part of this ordinance by reference, for the adjustments or construction of said water and/or sewer lines and facilities.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

SECTION 1: That the Metropolitan Government is authorized to enter into Utility Contract No. 5424 with the Tennessee Department of Transportation, attached hereto as Exhibit A and made a part of this ordinance by reference.

SECTION 2: That this ordinance shall take effect from and after its passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
