ORDINANCE NO. O99-1682

An ordinance approving a lease agreement between the Metropolitan Government of Nashville and Davidson County and Watkins Institute.

Whereas, the Metropolitan Government is a public corporation created pursuant to T.C.A. §§ 7-1-101, et seq., and vested with the authority to lease real property pursuant to Article 1, § 1.01 of the Metropolitan Charter; and

Whereas, the Metropolitan Development and Housing Agency is presently constructing a downtown public library (the "Downtown Library") for the benefit of the Metropolitan Government; and

Whereas, the completion of the Downtown Library will render the Ben West Library as superfluous and obsolete; and

Whereas, the Ben West Library’s highest and best use after the Downtown Library is completed is as a single tenant educational institution; and

Whereas, Watkins Institute is a state chartered educational institution, vested with the authority to enter into lease agreements for real property; and

Whereas, the Metropolitan Government desires to lease to Watkins Institute certain real property known as the "Ben West Library", which is located in Davidson County for the purpose of operating an educational institution, including all lawful uses ancillary thereto; and

Now, therefore, be it enacted by the Council of the Metropolitan Government of Nashville and Davidson County:

Section 1. The Lease between The Metropolitan Government of Nashville and Davidson County and Watkins Institute, which is attached hereto and incorporated by reference, is hereby approved and the Metropolitan County Mayor is authorized to execute the lease on behalf of the Metropolitan Government.

Section 2. Any further amendment to the Lease between the Metropolitan Government and the State of Tennessee must be approved by resolution of the Metropolitan Council that receives at least 21 affirmative votes.

Section 3. This ordinance shall take effect from and after its passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
