ORDINANCE NO. O99-1756

An ordinance to amend Title 17 of the Metropolitan Code of Laws, Section 17.40.040 - Zoning District Boundaries, relating to clarification of Planned Unit Development Overlay District boundaries, (Proposal No. 99Z-013T), all of which is described herein.

WHEREAS, Substitute Ordinance SO96-555 enacted a new comprehensive zoning code (Title 17 of the Metropolitan Code of Laws); and

WHEREAS, the Metropolitan Government of Nashville and Davidson County has monitored the effectiveness of the new code to implement the general plan and protect the health, safety and general welfare of the community; and

WHEREAS, it is now in the best interest of the citizens of Metropolitan Nashville and Davidson County to amend selected provisions of that new zoning code so as to better implement the general plan and protect the public health, safety and general welfare of the community;

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY.

SECTION 1. Section 17.40.040 shall be amended by adding letter "A" to the first sentence beginning with "Zoning district boundaries…" and replacing the existing letters A, B and C with numerals "1, 2, and 3", respectively.

SECTION 2. Section 17.40.040 shall be amended by adding an item "B" as follows:

B. Overlay district boundaries depicted on the official zoning map shall be interpreted as follows:

1. Overlay District Lines. Unless specified otherwise by the amending ordinance, overlay district boundaries indicated on the official zoning map that approximately follow zoning district lines shall be interpreted as being coincident with those zoning district lines.

2. Administrative Mapping Errors. Where it is determined that due to an administrative error, the official zoning map either depicts an overlay district boundary which encompasses property that was never intended to be included within the overly district boundary or fails to depict property which was intended to be included within an overlay district boundary, and such determination is supported by official documentation, the planning commission shall modify the official zoning map for the metro clerk to accurately reflect the proper overlay district boundary.

SECTION 3. This ordinance shall take effect five days from and after its passage upon publication of the caption and a summary of the ordinance in a newspaper of general circulation in Metropolitan Nashville, and Davidson County, the welfare of the Metropolitan Government of Nashville, and Davidson County requiring it.
