ORDINANCE NO. O99-1783

An ordinance abandoning a portion of a sewer casement, Book 3957, Page 49, RODC, encumbering the property of Map 116-08, Parcel No. 26 constructed under Project No. 64-S-51C.

WHEREAS, James C. Catignani is tile owner of real property encumbered by a sewer easement; and

WHEREAS, James C. Catignani intends to install a new sewer line to adequately serve the lots and adjacent properties; and

WHEREAS, a portion of the easement will no longer be used by the Department of Water and Sewer Services subject to the completion of the sewer line, more particularly described oil the plans for Project No. 99-SL-37, oil record in the office of the Director of Water and Sewerage Services, said plans are made part of hereof as though copied herein; and

WHEREAS, the Department of Water and Sewerage Services will have no future need for the existing easements; and

WHEREAS, the Planning Commission of The Metropolitan Government of Nashville and Davidson County will consider the abandonment of said portion of easement.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY.

SECTION 1: That a portion of the sewer easement of record in Book 3957 Page 49, Register's Office of Davidson County, is declared abandoned, and the Metropolitan Mayor is hereby authorized to execute tile appropriate instruments to carry out such an abandonment upon the construction of tile new sewer line properly conveyed to the Metropolitan Government.

SECTION 2: That this ordinance shall take effect after its passage, tile welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
