ORDINANCE NO. O99-1829
An Ordinance amending Contract No. 687 between The Metropolitan Government of Nashville and Davidson County and the State of Tennessee, Department of Transportation for STP-M-5333(1), Franklin Street, Corridor, 13th Avenue South to Interstate Drive, excluding bridge and minimum approaches over the Cumberland River.
Whereas, pursuant to Ordinance No. O96-274, the Metropolitan Government of Nashville and Davidson County and the State of Tennessee, Department of Transportation, entered into Contract No. 687, providing for development of the Franklin Street Corridor, from 13th Avenue South to Interstate Drive, excluding bridge and minimum approaches over the Cumberland River., funding and related matters for Project STP-M-5333(1); and
Whereas, the parties wish to amend Contract No. 687 to revise the funding percentage of Contract No. 687.
Whereas, it is the desire of the Metropolitan Government and the State of Tennessee to amend Contract No. 687 to reflect this change in funding and limits.
Now, therefore, be it enacted buy the Council of The Metropolitan Government of Nashville and Davidson County, Tennessee:
Section 1: The amendment submitted by the State of Tennessee, Department of Transportation to reflect a change in funding and limits is hereby accepted by the Metropolitan Government. The said Amendment is attached hereto and made a part thereof the same as though copied herein.
Section 2: That the Metropolitan County Mayor is authorized to execute the attached contract and any and all additional documents for STP-M-5333(1), Franklin Street Corridor, 13th Avenue South to Interstate Drive, excluding bridge and minimum approaches over the Cumberland River. These documents may include, but are not limited to, installation, operation, and maintenance of traffic signals and roadway/street lighting facalities; and the appropriation of funding for the construction realignment, relocation, and adjustments to water mains and/or sewer lines.
Section 3: That any and all additional contracts for Franklin Street Corridor, between the Department and the Metropolitan Government must be ratified by Resolution of The Metropolitan County Council prior to execution by the Metropolitan County Mayor.
Section 4. This Ordinance shall take effect from and after its passage, the welfare of the Metropolitan Government requiring it.
