ORDINANCE NO. O99-1784

An ordinance abandoning water and sewer easement encumbering Map 93-6-1 Parcel 61, 67 and Map 93-6-3 Parcel 6 of the proposed Down Town Public Library Project No. 99-SL-51 and Project No 99-WL-44 and authorizing the Metropolitan Mayor to execute the attached document.

WHEREAS, M.D.H.A. is the owner of real property encumbered by water and sewer easements; and,

WHEREAS, M.D.H.A. has installed a new sewer line which adequately serves the lots and the neighboring properties; and,

WHEREAS, a portion of the easements is no longer being used by the Department of Water and Sewerage Services, more particularly described on the plans for Project No. 99-SL-51 and Project No 99-WL-44, on record in the office of the Director of Water and Sewerage Services, said plans are made a part hereof as though copied herein; and,

WHEREAS, the Department of Water and Sewerage Services has no need for the said portion of easements; and,

WHEREAS, The Metropolitan Planning Commission of Nashville and Davidson County has already approved the abandonment of said portion of easement.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

SECTION 1: That this portion of the water sewer easements shown on Map 93-6-1 Parcels 61, 67 and Map 93-6-3 Parcel 6, is declared abandoned, and the Metropolitan Mayor is hereby authorized to execute the appropriate instruments to carry out such abandonment.

SECTION 2: That this ordinance take effect from and after its passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
