ORDINANCE NO. O99-1830

An Ordinance abandoning a 20' sewer easement encumbering Map I I 6-02-A, Parcel 4 of Hill Place, Project No. 95-SL-43, and authorizing the Metropolitan Mayor to execute the attached document.

WHEREAS, Robert H. and Lynn S. Ossoff (former owner and developer H. G. Hill Realty Company), is the owner of real property encumbered by a sewer easement of record in Book 6391, Page 530; and,

WHEREAS, a new sewer line has been installed which adequately serves the lots and the neighboring properties; and,

WHEREAS, a portion of the easement is no longer being used by the Department of Water and Sewerage Services, more particularly described on the plans for Project No. 95-SL-43, on record in the office of the Director of Water and Sewerage Services, said plans are made a part hereof as though copied herein; and,

WHEREAS, the Department of Water and Sewerage Services has no need for the said portion of easements; and,

WHEREAS, The Metropolitan Planning Commission of Nashville and Davidson County has already approved the abandonment of said portion of easement.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

SECTION 1: That this portion of the sewer easement shown on Map 116-02-A, Parcel 4 (formerly Map 116-2, Parcel 21, owned and developed as Hill Place by H. G. Hill Realty Company), is declared abandoned, and the Metropolitan Mayor is hereby authorized to execute the appropriate instruments to carry out such abandonment.

SECTION 2: That this ordinance take effect from and after its passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
