ORDINANCE NO. O99-1802

An ordinance approving a contract between The Metropolitan Government of Nashville and Davidson County and Siemens Building Technologies, Inc., for energy audits and consultant services to increase the energy efficiency of buildings owned by the Metropolitan Government.

Whereas, The Metropolitan Government of Nashville and Davidson County owns numerous buildings, many of which do not meet current standards for energy efficient operation; and

Whereas substantial savings in operational costs can be achieved if the buildings owned by the Metropolitan Government were more energy efficient; and,

Whereas, the Purchasing Agent, in cooperation with the Department of General Services issued a Request for Proposals for services to increase the energy efficiency of the Metropolitan Government’s buildings; and

Whereas, the proposal submitted by Siemens Building Technologies, Inc., was judged to be the best proposal; and

Whereas, a contract has been negotiated with Siemens Building Technologies, Inc., whereby the Metropolitan Government will receive energy audits and consulting services and Siemens will be reimbursed out of the documented savings in operational costs after each building is made to be more energy efficient; and

Whereas, in order for the financing package proposed by Siemens Building Technologies to be realized the term of the Contract is thirty (30) years so the Contract must be approved by the Metropolitan Council; and,

Whereas, it is in the best interest of the Metropolitan Government to enter into the Contract with Siemens Building Technologies, Inc.

Now, therefore, be it enacted by the Council of The Metropolitan Government of Nashville and Davidson County:

Section 1. That the Contract by and between The Metropolitan Government of Nashville and Davidson County and Siemens Building Technologies, Inc., for energy audits and consulting services to increase the energy efficiency of buildings owned by The Metropolitan Government of Nashville and Davidson County and which provides for a term of thirty (30) years, commencing on April 1, 1999 and which provides for reimbursement of Siemens based on verified savings in operational costs of each building that is made more energy efficient, is hereby approved.

Section 2. That any amendments to the Contract by and between the Metropolitan Government and Siemens Building Technologies, Inc., may be approved by resolution receiving twenty-one (21) votes.

Section 3. That this ordinance shall take effect from and after its passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.

AMENDMENT NO. 1

TO

BILL NO. 099-1802

Mr. President:

I move to amend Bill No. 099-1802 as follows:

(1) In the recitals, delete the term "Department of General Services" from the third "Whereas" clause and in its place insert the words "those Metropolitan Government departments with facility management responsibilities"; and

(2) In the recitals delete the phrase "energy audits and consulting services" from the fifth "Whereas" clause and in its place insert the words "energy conservation and cost reduction services"; and

(3) In the recitals delete the sixth "Whereas" clause and in its place insert the following:

Whereas, in order for the financing package of each project extended through Siemens Building Technologies to be fully amortized, the term of the contract is thirty (30) years so the contract must be approved by ordinance of the Metropolitan Council; and

(4) In Section I thereof delete the words "energy audits and consulting services" and substitute the words "energy conservation and cost reduction services."
