ORDINANCE NO. O99-1768

An ordinance authorizing Horace Bass to participate with the Metropolitan Government, Department of Water and Sewerage Services, for the construction of Project No. 99-SG-23, Woodland Street near South 9th Street.

WHEREAS, BASS has expressed a desire to provide public sewer system improvements across parcel 82-12-332 off Woodland Street near South 9th Street, Project No. 99-SG-23; and

WHEREAS, it is deemed in the best interest of the public to improve the sewer system across parcel 82-12-332 off Woodland Street near South 9th Street, and BASS is agreeable to paying its proportionate share of the total cost in an amount not to exceed $10,000; and

WHEREAS, this work is identified in Metro’s Capital Improvements Budget as Project No. 96SG0002.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

SECTION 1: That the Metropolitan Government is hereby authorized to accept from BASS an amount not to exceed $10,000.00 to aid in the construction of sewer system improvements off Woodland Street near South 9th Street, designated as Project No. 99-SG-23.

SECTION 2: That this ordinance shall take effect after its passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.

AMENDMENT NO. 1

TO

ORDINANCE O99-1768

Mr. President:

I move to amend Ordinance O99-1768 by adding the following as Section 2, and renumbering existing Section 2 as Section 3:

Section 2. Work on Project 99-SG-23 shall not proceed until such time as Horace Bass and/or Capitol City Mattress, Inc. Company shall have executed an indemnification in favor of the Metropolitan Government for any damages or injuries arising out of flooding subsequent to the construction of Project 99-SG-23. Such indemnification must be approved by the Director of Water & Sewage Services; the Director of Public Works; and the Director of Law.
