ORDINANCE NO. O99-1803

An ordinance approving an agreement relating to the development, management and application of floodplain and floodway data for the Cumberland River Corridor in Davidson County between the Federal Government, Department of the Army, and The Metropolitan Government of Nashville and Davidson County, acting by and through the Board of Parks and Recreation.

Whereas, pursuant to the agreement (the "Agreement"), attached as Exhibit A and incorporated into this ordinance by reference, the Federal Government, Department of the Army, proposes to undertake a study and database development project relating to floodplain and floodway areas along the Cumberland River Corridor in Davidson County (the "Project') and to fund fifty percent (50%) of the total cost of the Project, not to exceed twenty-one thousand eight hundred dollars ($21,800); and

WHEREAS, pursuant to the Agreement, the Metropolitan Government must ensure that matching funds not to exceed twenty-one thousand eight hundred dollars ($21,800) are provided by Greenways for Nashville for the Project; and

Whereas, approval of the Agreement will help to enhance the entertainment and recreational opportunities for Nashville's citizens and visitors.

Now, therefore, be it enacted by the Council of The Metropolitan Government of Nashville and Davidson County:

Section 1. The Agreement between The Metropolitan Government of Nashville and Davidson County and the Federal Government, Department of the Army (Exhibit A) is hereby approved.

Section 2. Any amendment to the Agreement must be approved by resolution of the Metropolitan Council receiving at least 21 affirmative votes.

Section 3. This ordinance shall take effect from and after its passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
