ORDINANCE NO. O99-1804

An ordinance to amend Chapter 4.12 of the Metropolitan Code of Laws to authorize the Metropolitan Purchasing Agent to participate in, sponsor, conduct, or administer a cooperative purchasing agreement for the procurement of any supplies, services or construction with one or more other local governments.

Whereas, Chapter 382 of the Public Acts of 1999 amended, Title 12, Chapter 3 of the Tennessee Code Annotated to add a new section which provides in pertinent part that "[a]ny municipality, county, utility district, or other local government of the state may participate in, sponsor, conduct, or administer a cooperative purchasing agreement for the procurement of any supplies, services or construction with one or more other local governments in accordance with an agreement entered into between the participants"; and

Whereas, The Metropolitan Government of Nashville and Davidson County would benefit from its participation in, sponsorship, conduct, or administration of cooperative purchasing agreements with one or more other local governments.

Now, therefore, be it enacted by The Metropolitan Council of The Metropolitan Government of Nashville and Davidson County:

Section 1: That chapter 4.12. of the Metropolitan Code of Laws be amended by adding a new section 4.12.095 that reads as follows:

4.12.095 Intergovernmental Cooperative Purchasing

To the extent permitted by state law, the purchasing agent is authorized to participate in, sponsor, conduct, or administer a cooperative purchasing agreement for the procurement of any supplies, services, or construction with one or more other local governments in accordance with an agreement entered into between the participants. Such cooperative purchasing may include, but is not limited to, joint or multi-party contracts between local governments. Where the participants in a joint or multi-party contract are required to advertise and receive bids, it shall be sufficient for those purposes that the purchasing entity comply only with its own purchasing requirements.

Section 2: That this Ordinance shall take effect from and after its passage, the welfare of the Metropolitan Government of Nashville and Davidson County requiring it.
