ORDINANCE NO. O99-1823

An ordinance abandoning a portion of easements retained by Ordinance No. O96-157 by closing a segment of Old Hickory Boulevard, between the south margin of Old Hickory Boulevard and the east property line of Parcel 186 on Map 162, all of which is more particularly described herein.

WHEREAS, the Metropolitan Council adopted Ordinance No. O96-157 which closed a segment of Old Hickory Boulevard, between the south margin of Old Hickory Boulevard and the east property line of Parcel 186 on Map 162, however, easements were retained within said portion of the street being closed; and

WHEREAS, there is no further need for retaining all of the closed street area for easements.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

SECTION 1. That Ordinance No. O96-157 shall be and the same is hereby amended by abandoning the westerly thirty (30) feet portion of the easement area which was retained by the adoption of said ordinance, leaving only the easterly twenty (20) feet of area of the closed street being retained as easement area.

SECTION 2. This Ordinance shall take effect after its passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.

AMENDMENT NO. 1

TO

ORDINANCE NO. O99-1823

Mr. President:

I move to amend Ordinance No. O99-1823 as follows:

  1. By adding a new Section 2:
  2. "SECTION 2. That the provisions of Section 1. shall not take effect until any existing water and/or sewer lines have been relocated and accepted by the department of water and sewerage services, and an appropriate plat has been approved by the planning commission and recorded."

  3. By renumbering the existing Section 2. to become Section 3.
