ORDINANCE NO. O99-1795

An ordinance amending Section 6.64.110 of the Metropolitan Code of Laws to allow the Charitable Solicitations Board to waive the requirement that an applicant for a permit must appear before the Board.

Whereas, some applicants for a Charitable Solicitations Permit do not have a principal office in the vicinity of Metropolitan Nashville;

Whereas, some applicants only solicit a small percentage of their contributions from Davidson County;

Whereas, giving the Charitable Solicitations Board the power to communicate with representatives of organizations in ways other than in person allows the Board to obtain the same information they would if the organization’s representative appeared in person:

Now, therefore, be it enacted by the Council of the Metropolitan Government of Nashville and Davidson County as follows:

Section 1: Title 6, Chapter 6.64, Section 6.64.110(A)(21) of the Metropolitan Code of Laws is hereby amended by making the existing section 6.64.110(A)(21)(A) and adding a new subsection 6.64.110(A)(21)(B) as follows:

B. The Charitable Solicitations Board may waive the personal appearance requirement of Subsection (A) and approve the applicant’s permit application by a majority vote of the Board. The Charitable Solicitations Board may adopt alternative requirements for the personal appearance required in subsection (A) including, but not limited to, a telephone conference or a written question procedure.

Section 2: This Ordinance shall take effect from and after its passage, the welfare of the Metropolitan Government of Nashville and Davidson County requiring it.
