ORDINANCE NO. O99-1697

An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by changing from AR2a District to IR District properties at Murfreesboro Pike (unnumbered) and Couchville Pike (unnumbered), north of McGavock Pike, Donelson Pike (unnumbered) and east of Donelson Pike (677.69 acres), (Proposal No. 99Z-080U), all of which is more particularly described herein.

Whereas, The Metropolitan Government of Nashville and Davidson County (the "Metropolitan Government"), is vitally interested in the economic welfare of the citizens of Davidson County and wishes to provide the necessary leadership to enhance this area’s capabilities for growth and development; and

Whereas, the provision of jobs to area citizens by local business is both necessary and vital to the economic well-being of the Metropolitan Government; and

Whereas, the Metropolitan Government is also vitally interested in promoting industry, developing trade, and stimulating the economic growth of its community; and

Whereas, Dell Computer Corporation ("Dell"), a Fortune 500 company with headquarters in Round Rock, Texas, has announced its tentative decision to locate expand its US operations, which expansion initially will include locating computer manufacturing, distribution and customer support and call center facilities (the "Project") in Nashville; and

Whereas, the location of the Project in Nashville will result in significant employment and other commercial opportunities for area citizens; and

Whereas, the Metropolitan Government and the Metropolitan Nashville Airport Authority own certain property which property will become the site for Dell’s middle-Tennessee manufacturing and distribution operations and office facilities; and

Whereas, the Metropolitan Government and the Metropolitan Nashville Airport Authority desire to rezone the property to IR District to enable Dell to locate its facilities on this site.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

SECTION 1. That Title 17 of the Code of Laws of The Metropolitan Government of Nashville and Davidson County, be and is hereby amended by making certain changes in the Official Zoning Map for Metropolitan Nashville and Davidson County, which is made a part of said Title 17 by reference, as follows:

By changing from AR2a District to IR District properties at Murfreesboro Pike (unnumbered) and Couchville Pike (unnumbered), north of McGavock Pike, Donelson Pike (unnumbered), and east of Donelson Pike (677.69 acres), being more particularly described as being Property Parcel No. 157 (149.77 acres) and Part of Parcel No. 154 (117 acres) as designated on Map 120, part of Property Parcel Nos. 4 (208 acres) and 87 (165 acres) as designated on Map 121, and Property Parcel Nos. 302 (6.79 acres) and 310 (31.13 acres) as designated on Map 134 of the Official Property Identification Maps of The Metropolitan Government of Nashville and Davidson County, all of which is more particularly described by lines, words and figures on the attached plan, which is attached to and made a part of this ordinance as though copied herein.

SECTION 2. BE IT FURTHER ENACTED, That the Metropolitan Clerk is hereby authorized and directed, upon the enactment and approval of this ordinance, to cause the change to be made on Sheet Nos. 120, 121 and 134 of said Official Zoning Map for Metropolitan Nashville and Davidson County, as set out in Section 1 of this ordinance, and to make notation thereon of reference to the date of passage and approval of this amendatory ordinance.

SECTION 3. BE IT FURTHER ENACTED, That this ordinance take effect immediately after its passage and such change be published in a newspaper of general circulation, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
