Metropolitan Council Meeting

Tuesday, May 18, 1999


The Metropolitan Council met in regular session on this date at 7:00 p.m. in the Metropolitan Courthouse.

The invocation was offered by Councilmember Ron Nollner.

The Metropolitan Council gave the pledge of allegiance to the American Flag.

Re: Veto of Resolution R99-1531

Dear Vice Mayor West and Members of the Council:

I am returning the Resolution R99-1531 to you marked "veto."

I have not in the past vetoed any such resolutions, and the only reason in this case is to ensure that the Council has taken into account all the various factors relating to this. If the Council wishes to go on the record with this resolution, or with any variation, you don't need to override the veto; just pass it again and I will sign it.

The issue is this: Mr. Brewington is engaged in a dispute with the Sports Council over the rights to the name "Music City Bowl," a dispute which may well end up in litigation. It is at the moment a messy situation. The wording of the resolution would put the Council clearly on record as accepting and affirming Mr. Brewington's version of the facts, and against the Sports Council's version.

While Denny Brewington is a fine person, and certainly deserves recognition for his contributions to the Music City Bowl concept, I would question whether the Council would want to enter the fray at this point by an action such as this resolution. Please consider an alternative course, such as either abstaining altogether or passing a more generic resolution that thanks him for his contributions without affirming his version of the disputed facts.

- PUBLIC HEARING -

BILL NO. O99-1647

An ordinance approving Amendment No. 1 to the East Bank Redevelopment Plan. The bill was approved by the Planning Commission, Federal Grants Review and Planning, Zoning, Historical and Port Authority Committees. Ms. Beehan requested a hearing from the public on this bill which had been previously advertised. The President asked if anyone desired to be heard for or against the bill, and citizens were heard on the proposal. The President declared the public hearing closed. Ms. Beehan moved to pass the bill on second reading, which motion was seconded and adopted by a voice vote of the Council.

- RESOLUTIONS-

RESOLUTION NO. R99-1458

A resolution requesting the Davidson County Delegation to the Tennessee General Assembly to have enacted necessary provisions to permit the removal of the local option sales tax on groceries. The Rules-Confirmations-Public Elections-Aviation Committee recommended indefinite deferment of the resolution. Mr. Sloss moved to defer action indefinitely on the resolution, which motion was seconded and adopted by a voice vote of the Council.

RESOLUTION NO. R99-1508

A resolution requesting annual reports from Metro Government departments about the number of employees who speak languages other than English and about the percentage of department employees who have completed diversity training program offered by the Metro Personnel Department. The Rules-Confirmations-Public Elections-Aviation Committee recommended deferment of the resolution. Mr. Ferrell moved to defer action on the resolution, which motion was seconded and adopted by a voice vote of the Council.

A resolution authorizing the Metropolitan Government to enter into Utility Contract No. 5352 with the State of Tennessee, Department of Transportation, for the construction of certain utilities, said construction being necessary as part of State Project Nos. 19039-3227-04 and 19039-2222-04 involving construction of SR-24 (Charlotte Pike) bridge over CSX Railroad (Metro Project Nos. 96-SG-116 and 96-WG-87). The resolution was approved by the Budget and Finance Committee; Public Works Committee recommended deferment of the resolution. A resolution amending R98-1226 which approved a grant from State of Tennessee, for the provision of health services including adolescent pregnancy initiative, children's special services, tuberculosis services, renal intervention, oral health, lead poisoning, community prevention initiative, community development services, grant-in-aid and Families First to increase the funds by $33,000 for a total grant of $3,411,465.
