ORDINANCE NO. O99-1670

An ordinance approving an agreement and accepting a grant in the amount of $8,200,000 from the Federal Government through the State of Tennessee, Department of Transportation, to the Metropolitan Government of Nashville and Davidson County, acting by and through the Board of Parks and Recreation, for the purpose of implementing Project No. HPP-9312(28) relating to the design and construction the Stones River and Mill Creek Greenways, and approving matching funds in the amount of $2,050,000.

WHEREAS, Pursuant to the agreement (the "Agreement") attached as Exhibit A and incorporated into this Ordinance by reference, the Federal Government, acting through the State of Tennessee Department of Transportation, proposes to make a grant in the amount of eight million two hundred thousand dollars ($8,200,000) to the Metropolitan Government of Nashville and Davidson, acting through the Board of Parks and Recreation, for use in Project No. 98PR201 and Project No. 97PR403, relating to the design and construction of the Stones River and Mill Creek Greenways (collectively, the "Project"); and

WHEREAS, pursuant to the Agreement, the Metropolitan Government must provide matching funds in the amount of two million fifty thousand dollars ($2,050,000) for the Project; and

WHEREAS, acceptance of the grant and provision of the matching funds described in the Agreement will help to enhance the entertainment and recreational opportunities for Nashville’s citizens and visitors.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

SECTION 1. The Agreement between the Metropolitan Government of Nashville and Davidson County and the Federal Government, acting through the State of Tennessee, Department of Transportation (Exhibit A) is hereby approved and the Metropolitan Mayor is authorized to execute the Agreement on behalf of the Metropolitan Government.

SECTION 2. Matching funds in the total amount of two million fifty thousand dollars ($2,050,000) are hereby approved, to be derived from the issuance of general obligation bonds for Project No. 98PR201 (Greenways – Stones River Greenway Development Project) and Project No. 07PR403 (Mill Creek Greenway System/Develop).

SECTION 3. Any amendment to the Agreement must be approved by resolution of the Metropolitan Council receiving at least 21 affirmative votes.

SECTION 4. This ordinance shall take effect from and after its passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
