ORDINANCE NO. O99-1612
An ordinance amending Title 17 of the Metropolitan Code of Laws, the Zoning Code of the Metropolitan Government of Nashville and Davidson County, by making applicable to various parcels in Hillsboro Village along portions of 19th, 20th and 21st Avenues South, and portions of Blakemore, Wedgewood, Belcourt, and Acklen Avenues (23.19 acres), classified RM40, OR20 and CL and proposed for MUN and MUL, the provisions of the Urban Design Overlay District, (Proposal No. 99Z-035U), all of which is more particularly described herein.
WHEREAS, pursuant to Section 17.36.270 of the Zoning Regulation, on February 4, 1999, the Metropolitan Planning Commission amended the Subarea 10 Plan by designating the Hillsboro Village Special Design Treatment Area as an area warranting special regulation of design and setting forth design goals and objectives for the designated area, thereby establishing the eligibility of this area for the application of the Urban Design Overlay district; and
WHEREAS, consultants retained by the Metropolitan Planning Commission working closely with groups and individuals with a wide range of interests in the Hillsboro Village area and the Metropolitan Planning Commission, prepared a design plan and associated design criteria, entitled Hillsboro Village Design Guidelines [the Guidelines], to implement the goals and objectives for the Hillsboro Village Special Design Treatment Area;
NOW, THEREFORE, BE IT ENACTED BY THE METROPOLITAN COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:
SECTION 1. THAT IT IS HEREBY FOUND AND DETERMINED that the area proposed for the application of the Urban Design Overlay district is eligible for said application, and that the proposal otherwise conforms to the General Plan for Nashville.
SECTION 2. BE IT FURTHER ENACTED, That Title 17 of the Code of Laws of The Metropolitan Government of Nashville and Davidson County, be and is hereby amended by making certain changes in the Official Zoning Map for Metropolitan Nashville and Davidson County, which is made a part of said Title 17 by reference, as follows:
By applying an Urban Design Overlay District to various parcels in Hillsboro Village along portions of 19th, 20th and 21st Avenues South, and portions of Blakemore, Wedgewood, Belcourt, and Acklen Avenues (23.19 acres), being more particularly described as being various parcels as designated on Map 104 of the Official Property Identification Maps of The Metropolitan Government of Nashville and Davidson County, all of which is more particularly described on Exhibit 1 entitled " Properties Included In The Hillsboro Village Urban Design Overlay District" and Exhibit 2 entitled "Hillsboro Village Design Guidelines," consisting of text, tables, maps and other graphics, and an appendix, all of which are attached to and made a part of this ordinance as though copied herein, all dated March 26, 1999, as filed with the Metropolitan Clerk.
SECTION 3. BE IT FURTHER ENACTED, That the Metropolitan Clerk is hereby authorized and directed, upon the enactment and approval of this ordinance, to cause the change to be made on Sheet No. 104 of said Official Zoning Map for Metropolitan Nashville and Davidson County, as set out in Section 1 of this ordinance, and to make notation thereon of reference to the date of passage and approval of this amendatory ordinance.
SECTION 4. BE IT FURTHER ENACTED, That this ordinance take effect immediately after its passage and such change be published in a newspaper of general circulation, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
SECTION 5. BE IT FURTHER ENACTED, That the Metropolitan Clerk is directed to file this Ordinance together with the Guidelines referred to herein as a part of the minutes of this meeting.

AMENDMENT NO. 1
TO
ORDINANCE NO. O99-1612
Mr. President:
I move to amend Ordinance No. O99-1612 by deleting the "Subdistricts" map as it appears on page 4 of Exhibit 2 entitled "The Hillsboro Village Design Guidelines" and substituting in lieu thereof the attached new "Subdistricts" map which applies subdistrict Commercial Core South (Subdistrict 1B) to parcels 117 and 118 on tax map 104-8 thereby removing subdistrict Belcourt Residential Building Types (Subdistrict 2B) from these two properties.
