ORDINANCE NO. O99-1616

An ordinance to amend Chapter 17.04 (General Provisions and Definitions), Chapter 17.08 (Zoning Districts and Land Uses), Chapter 17.16 (Land Use Development Standards) of Title 17 of the Metropolitan Code of Laws, the Zoning Code of the Metropolitan Government of Nashville and Davidson County, (99Z-007T) all of which is more particularly described herein.

WHEREAS, Substitute Ordinance SO96-555 enacted a new comprehensive zoning code (Title 17 of the Metropolitan Code of Laws); and

WHEREAS, Ordinance O98-1321 and O98-1323 recently amended the zoning code (Title 17 of the Metropolitan Code of Laws); and

WHEREAS, the Metropolitan Government of Nashville and Davidson County has monitored the effectiveness of that new code to implement the general plan and protect the health, safety and general welfare of the community; and

WHEREAS, it is now in the best interest of the citizens of Metropolitan Nashville and Davidson County to amend selected provisions of that new zoning code so as to better implement the general plan and protect the public health, safety and general welfare of the community;

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

SECTION 1. That Title 17 of the Metropolitan Code of Laws, be and is hereby amended as specifically described in Exhibit A, attached hereto and incorporated herein; and

SECTION 2. This ordinance shall take effect five days from and after its passage upon publication of the caption and a summary of the ordinance in a newspaper of general circulation in Metropolitan Nashville and Davidson County, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.

Exhibit A

Chapter 17.04 (General Provisions and Definitions)

…amend Section 17.04.050 (Rules for construction of language) to insert item H. Fractions as follows and to renumber the items following it.

H. Fractions. When any requirement of these regulations results in a fraction of a dwelling unit or other measurement, that fraction will be disregarded and the fraction if less than 0.5 shall be rounded down to the nearest whole number, and if equal to or greater than 0.5 shall be rounded up to the nearest whole number.

 

Chapter 17.08 (Zoning Districts and Land Uses)

…amend Table 17.08.030 (Single-family and two-family dwellings) to insert a PC (permitted w/ conditions) for single-family dwellings in the ON district and single-family and two-family dwellings in the MUN district.

Chapter 17.16 (Land Use Development Standards)

…amend Section 17.16.030 (Permitted use w/conditions: Residential Uses to insert as item D "Single-Family and Two-Family Dwellings in the ON or MUN districts" as follows:

Single-family and Two-Family Dwellings in the ON or MUN Districts.

In the ON district, single-family dwellings and in the MUN district, single-family and two-family dwellings, shall be permitted provided the proposed lots comply with the bulk standards and landscape buffer yard requirements of the residential zoning district whose minimum lot size is equivalent to those being proposed. As an example, a subdivision in the ON district proposing a 5,000 square foot lot size would comply with the RS5 district standards.

…amend Section 17.16.160.A (Residential Special Exceptions: Historic Bed and Breakfast Homestay) to delete in the second sentence in its entirety and insert the following in its place:

"…The commission shall advise on the appropriate location and potential adverse impacts caused by the off-street parking of vehicles, and may recommend fencing, screening and landscaping to buffer and protect surrounding residential properties."
