ORDINANCE NO. O99-1590

An ordinance amending Chapter 12.42 and Chapter 12.40 of the Metropolitan Code relating to the residential permit parking program by making such program area based rather than block based.

WHEREAS, the Traffic and Parking Commission desires to have the permit parking program provided in Chapter 12.42 of the Metropolitan Code to be based upon areas of residential areas rather than based on blocks of residential areas.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

SECTION 1. Section 12.42.010 of the Metropolitan Code shall be and the same is hereby amended by deleting the definition "Residential permit parking block (RPP)" and substituting in lieu thereof the following new definition:

"Residential permit parking areas (RPP)" means a residential area designated as herein provided where resident motor vehicles displaying a valid permit as described herein shall be exempt from parking time restrictions established pursuant to this article."

SECTION 2. Section 12.42.020 of the Metropolitan Code shall be and the same is hereby amended by deleting the word "zones" wherein it appears in the caption and substituting in lieu thereof the word "areas".

SECTION 3. Section 12.42.030 of the Metropolitan Code shall be and the same is hereby amended by deleting the word "blocks" wherein it appears in the caption and substituting in lieu thereof the word "areas" and further by deleting the word "block" wherein it appears in the first sentence and substituting in lieu thereof the word "area".

SECTION 4. Section 12.42.040 of the Metropolitan Code shall be and the same is hereby amended by deleting the word "blocks" wherein it appears in the caption and substituting in lieu thereof the word "areas" and further by deleting the word "block" wherein it appears in the said section and substituting in lieu thereof the word "area", and by deleting the work "blocks" wherein it appears in said section and substituting in lieu thereof the word "areas". Said section shall be further amended by deleting the second sentence and substituting the following new sentence in lieu thereof:

"The petition must be signed by twenty-five percent of the residents within the geographic limits as stated in the petition."

SECTION 5. Section 12.42.050 of the Metropolitan Code shall be and the same is hereby amended by deleting the words "block" and "blocks" wherein they appear in said section and substituting in lieu thereof the word "area". Said section shall be further amended by inserting the word "a" after the word " as" and before the word "residential" wherein they appear in the first sentence.

SECTION 6. Section 12.42.060 of the Metropolitan Code shall be and the same is hereby amended by deleting the word "block" wherein it appears in said section and substituting in lieu thereof the word "area".

SECTION 7. Section 12.42.070 of the Metropolitan Code shall be and the same is hereby amended by deleting the words "block" and "blocks" wherein they appear in said section and substituting in lieu thereof the word "area" or "areas" as the case may be. Said section shall be further amended by deleting the word "zone" wherein it appears in the first sentence and substituting in lieu thereof the word "area".

SECTION 8. Section 12.42.080 of the Metropolitan Code shall be and the same is hereby amended by deleting the word "block" wherein it appears in said section and substituting in lieu thereof the word "area".

SECTION 9. Section 12.42.0980 of the Metropolitan Code shall be and the same is hereby amended by deleting the word "block" and the word "zone" wherein they appear in said section and substituting in lieu thereof the word "area".

SECTION 10. Section 12.40.040, subparagraph A.2.j. of the Metropolitan Code shall be and the same is hereby amended by deleting the word "block" wherein it appears in said section and substituting in lieu thereof the word "area".

SECTION 11. This Ordinance shall take effect from and after its passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.

AMENDMENT NO. 1

 

TO

ORDINANCE NO. O99-1590

Mr. President:

I move to amend Ordinance No. O99-1590 by amending Section 4 thereof by deleting the phrase "twenty-five percent" wherein it appears, and substituting in lieu thereof the phrase "seventy-five percent".
