SUBSTITUTE ORDINANCE NO. SO99-1668

A substitute ordinance amending section 10.20.240 of the Metropolitan Code of Laws to change the disposition of funds derived from tip fees for solid waste and reallocating funds.

Whereas, Section 10.20.240 of the Metropolitan Code of Laws sets out the distribution and use of the funds derived from the tip fees established by Sections 10.20.200-10.20.230 of the Code; and

Whereas, it is in the best interest of the Metropolitan Government to redistribute the use of said fees.

Now, therefore, be it enacted by the Council of The Metropolitan Government of Nashville and Davidson County:

Section 1. Section 10.20.240 of the Metropolitan Code of Laws is hereby repealed in its entirety and the following is substituted in lieu thereof:

Five sixths of the funds derived from the tip fee shall be placed in the solid waste disposal fund, and one sixth shall be placed in the recycling fund. Moneys from the recycling fund may not be expended or appropriated except by specific resolution of the Metropolitan Council.

Section 2. Any funds heretofore placed in and accumulated in the transportation fund, No. 1-46-MP599.531, (FASTnet No. 30504-42712000), and 1-146-MP599.532, (FASTnet No. 30504-42712100), shall be allocated and appropriated to the solid waste disposal fund, No. 1-146-MP599.501, (FASTnet No. 30501-42700100).

Section 3. That should any clause or provision of this ordinance be declared by a court of competent jurisdiction to be unconstitutional or invalid, such decision shall not affect the validity of this ordinance as a whole or any provision other than the part declared to be unconstitutional or invalid, such section, clause and provision hereof being declared severable.

Section 4. That this ordinance shall take effect from and after its passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
