RESOLUTION NO. R99-1558

A resolution authorizing the Metropolitan Department of law to compromise and settle the claim of Cypress-Guttman against The Metropolitan Government of Nashville and Davidson County for an amount not to exceed $25,014.94 and directing that this amount be paid from the self insured liability account.

Whereas, on January 23 1999 and Febrary 16, 1999, claimant’s property located at 1040 Murfreesboro Road was damaged resulting from sewer waste back-up which caused the shut-down of several businesses at said location for clean-up and repair; and,

WHEREAS, after investigation, the Department of Law believes that the settlement listed in Section 1 is fair and reasonable and in the best interest of the Metropolitan Government, and recommends that the claim be compromised and settled, and that this amount be paid from the Self Insured Liability Account.

Now, therefore, be it resolved by the Council of The Metropolitan Government of Nashville and Davidson County:

Section 1: The Metropolitan Department of Law is authorized to compromise and settle the claim of Cypress-Guttman in an amount not to exceed $25,014.94. Said amount shall be paid from the Self Insured Liability Account.

Section 2: This Resolution shall take effect from and after its adoption, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
