ORDINANCE NO. O99-1598

An ordinance authorizing the Metropolitan Government to participate with Bimal Patel for the construction of Project No. 98-WL-158, Church Street East.

WHEREAS, Bimal Patel has expressed a desire to provide public water service improvements to certain property in Church Street East; and

WHEREAS, it is deemed in the best interest of the public to construct the water service improvements, and the Metropolitan Government is agreeable to pay the lessor of 50% of the installation cost, or $6,000 to Bimal Patel in aid of the construction; and

WHEREAS, this work is identified in METRO’S CAPITAL IMPROVEMENTS BUDGET as Project No. 96-WG-0001.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

SECTION 1: That the Metropolitan Government is hereby authorized to execute the attached agreement, Exhibit 1, authorizing payment to Bimal Patel for the lessor of 50% of the installation cost, or $6,000, to aid in the construction of the water service improvements designated as Project No. 98-WL-158, to be paid from the Water and Sewer Replacement Fund.

SECTION 2: That the payment authorized in Section 1 shall not be made until Bimal Patel has executed a Deed of Conveyance for the improvements to the Metropolitan Government and proof of having released all mechanics and materialmans liens.

SECTION 3: That this ordinance shall take effect after its passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
