ORDINANCE NO. O99-1600

An ordinance authorizing the Metropolitan Government to participate with Belmont University for the construction of Project No. 98-WL-164, Belmont Boulevard at Portland Avenue.

WHEREAS, Belmont University has expressed a desire to provide public water system improvements to certain property in the Belmont Blvd. & Portland Avenue area; and

WHEREAS, it is deemed in the best interest of the public to construct the water system improvements, and the Metropolitan Government is agreeable to paying the lessor of 50% of the installation cost or $35,000; and

WHEREAS, this work is identified in METRO’S CAPITAL IMPROVEMENTS BUDGET as Project No. 96-WG-0001.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

SECTION 1: That the Metropolitan Government is hereby authorized to execute the attached agreement, Exhibit 1, authorizing payment to Belmont University for the lessor of 50% of the installation cost or $35,000 to aid in the construction of the water improvements designated as Project No. 98-WL-164, to be paid from the Water and Sewer Replacement Fund.

SECTION 2: That the payment authorized in Section 1 shall not be made until Belmont University has executed a Deed of Conveyance to the Metropolitan Government for the improvements and proof of having released all mechanics and materialmans liens.

SECTION 3: That this ordinance shall take effect after its passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
