SUBSTITUTE BILL NO. SO99-1671

A substitute ordinance approving an agreement and accepting a grant in the amount of $150,000 from the State of Tennessee, Department of Environment and Conservation, to The Metropolitan Government of Nashville and Davidson County, acting by and through the Board of Parks and Recreation, for use in the design and construction of the Mill Creek Greenway, and approving matching funds in the amount of $150,000.

Whereas, pursuant to the agreement (the "Agreement") attached as Exhibit A and incorporated into this Ordinance by reference, the State of Tennessee Department of Environment and Conservation proposes to make a grant in the amount of one hundred fifty thousand dollars ($150,000) to The Metropolitan Government of Nashville and Davidson, acting through the Board of Parks and Recreation, for use in design and construction of the Mill Creek Greenway; and

Whereas, pursuant to the Agreement, the Metropolitan Government must provide matching funds in the amount of one hundred fifty thousand dollars ($150,000) for the Project; and

Whereas, acceptance of the grant and provision of the matching funds described in the Agreement will help to enhance the entertainment and recreational opportunities for Nashville’s citizens and visitors.

Now, therefore, be it enacted by the Council of The Metropolitan Government of Nashville and Davidson County:

Section 1: The Agreement between The Metropolitan Government of Nashville and Davidson County and the federal government, acting through the State of Tennessee, Department of Environment and Conservation (Exhibit A) is hereby approved and the Metropolitan Mayor is authorized to execute the Agreement on behalf of the Metropolitan Government.

Section 2: Matching funds in the total amount of one hundred fifty thousand dollars ($150,000) are hereby approved, to be derived from the issuance of general obligation bonds for Project No. 97PR403 (Mill Creek Greenway System/Develop).

Section 3: Any amendment to the Agreement must be approved by resolution of the Metropolitan Council receiving at least 21 affirmative votes.

Section 4: This ordinance shall take effect from and after its passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
