SUBSTITUTE ORDINANCE NO. SO99-1561

A substitute ordinance authorizing the Metropolitan Mayor to execute an agreement for the exchange of equipment installation rights between the Metropolitan Department of Water and Sewerage Services and Sprint Spectrum L.P.

WHEREAS, Metro Water Services operates equipment on various sites in Davidson County where there is sufficient space to accommodate the installation of telecommunications equipment belonging to Sprint Spectrum, L.P. ("Sprint"); and

WHEREAS, Sprint operates equipment on various sites in Davidson County where there is sufficient space to accommodate the installation of telecommunications equipment belonging to Metro Water Services; and

WHEREAS, both parties seek to install certain telecommunications equipment on sites belonging to the other party; and

WHEREAS, entry into the Agreement will benefit the citizens of Davidson County by improving the communications capabilities of Metro Water Services and improving the quality of communications services generally available within Davidson County.

NOW THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

SECTION 1: That the Metropolitan Mayor is hereby authorized to execute the attached Agreement between The Metropolitan Government of Nashville and Davidson County and Powertel/Memphis, Inc.

SECTION 2: That any amendments, renewals or extension of the terms of the Agreement must be approved by Resolution of the Metropolitan Council.

SECTION 3: That this Ordinance shall take effect from and after its passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
