ORDINANCE NO. O99-1657

An ordinance amending Ordinance No. 093-685 by changing the nullification fee from nine dollars ($9) to twelve dollars ($12).

Whereas, pursuant to Section 14.22(A) of the Metropolitan Charter, the Council of the Metropolitan Government may set fees in cases involving the violation of ordinances, regulations, resolutions or private acts of the Metropolitan Government; and

Whereas, the Metropolitan Government of Nashville and Davidson County incurs costs when non-moving traffic violations are nullified by the Nullification Office or conditionally dismissed by the Metropolitan General Sessions Court; and

Whereas, the current $9 nullification fee is insufficient to cover the costs associated with the nullification program; and

Whereas, the Metropolitan Council deems it to be in the best interest of the citizens of Metropolitan Nashville and Davidson County to adopt, by ordinance, provisions relative to the nullification fee.

Now, therefore, be it enacted by the council of the Metropolitan Government of Nashville and Davidson County:

Section 1: Section 1 of Ordinance 93-685 is deleted in its entirety and replaced by the following:

There shall be a fee of $12 whenever a citation involving a non-moving traffic violation listed in the Metropolitan Code of Laws, Section 12.32.090 is nullified by the Nullification Office or is dismissed by the General Session Court upon the correction of the violation. This fee may be waived by the General Sessions Court Judges in cases of financial hardship.

Section 2: That this Ordinance shall take effect after its passage, the welfare of the Metropolitan Government of Nashville and Davidson County requiring it.
