Metropolitan Council Meeting
Tuesday, September 5, 2000


The Metropolitan Council met in regular session on this date at 7:00 p.m. in the Metropolitan Courthouse.

The invocation was offered by Reverend Edward E. Bufford of Clark Memorial United QMethodist Church. Mr. Wallace moved that a copy of the invocation be placed on file in the Metropolitan Clerk’s Office, which motion was seconded and adopted without objection.

The Metropolitan Council gave the pledge of allegiance to the American Flag.

The roll was called and the following members were present during the progress of the meeting: Waters, Briley, Gentry, Tucker, Gilmore, Black, Nollner, Majors, Hall, Beehan, Campbell, Hart, Dillard, Balthrop, Brown, Ponder, Derryberry, McClendon, Greer, Hausser, Wallace, Haddox, Whitmore, Hand, Bogen, Summers, Shulman, Arriola, Sontany, Alexander, Holloway, Kerstetter, Knoch, Jenkins, Turner, Williams, Lineweaver (37); Absent: Ferrell, Stanley, Loring, Steine (4).

Mr. Turner moved that Mr. Waters be authorized to preside at this meeting in the absence of President Steine and President Pro Tem Ferrell. The motion was seconded and unanimously adopted.

The Minutes of the regular meeting of August 15, 2000, were approved.

Mr. Waters announced that an election to fill two Council member seats on the Council Audit Committee would be held at the next regular meeting of the Council.

Mr. Greer, Vice Chairman of the Rules-Confirmations-Public Elections Committee, moved that the November 7, 2000, meeting of the Metropolitan Council be moved to Thursday, November 9, 2000, to avoid conflicting with the presidential election on the regular meeting date. The motion was seconded and adopted by a unanimous vote of the Council.

- ELECTIONS AND CONFIRMATIONS -

President Pro Tem

Mr. Waters called for nominations to fill the position of President Pro Tem of the Council for a one-year term expiring August 31, 2000. Mr. Campbell nominated Ms. Beehan, which motion was seconded. Mr. Alexander nominated Ms. Holloway, which motion was seconded. The vote was taken and recorded as follows: Beehan: Briley, Beehan, Campbell, Ponder, Derryberry, McClendon, Hausser, Shulman, Jenkins, and Turner (10); Holloway: Waters, Gentry, Tucker, Gilmore, Black, Nollner, Majors, Hall, Hart, Balthrop, Brown, Greer, Wallace, Haddox, Whitmore, Hand, Bogen, Arriola, Sontany, Alexander, Holloway, Kerstetter, Knoch, and Lineweaver (24); "Abstaining" Williams (1). Mr. Waters declared that Ms. Holloway was elected President Pro Tem for a one-year term. After a brief recess,

Ms. Holloway assumed the chair.

Electrical Examiners and Appeals Board

Appointment of Mr. Lynn Cawthorne as the heating and air specialist for a term expiring April 16, 2004. The Rules-Confirmations-Public Elections Committee recommended appointment and Mr. Greer moved for confirmation, which motion was seconded and adopted by a unanimous vote of the Council.

Farmers Market Board

Reappointment of Mr. Warren Jasper for a term expiring July 7, 2005. The Rules-Confirmations-Public Elections Committee recommended appointment and Mr. Greer moved for confirmation, which motion was seconded and adopted by a unanimous vote of the Council.

Transit Authority

Appointment of Mr. Lewis Lavine for a term expiring July 18, 2005. The Rules-Confirmations-Public Elections Committee recommended appointment and Mr. Greer moved for confirmation, which motion was seconded and adopted by a unanimous vote of the Council.

Work Release Commission

Reappointment of Mr. Jim Boyd for a term expiring August 1, 2004. The Rules-Confirmations-Public Elections Committee recommended appointment and Mr. Greer moved for confirmation, which motion was seconded and adopted by a unanimous vote of the Council.

Reappointment of Ms. Mona Frederick for a term expiring August 1, 2004. The Rules-Confirmations-Public Elections Committee recommended appointment and Mr. Greer moved for confirmation, which motion was seconded and adopted by a unanimous vote of the Council.

Reappointment of Dr. N. Horace Mann for a term expiring August 1, 2004. The Rules-Confirmations-Public Elections Committee recommended appointment and Mr. Greer moved for confirmation, which motion was seconded and adopted by a unanimous vote of the Council.

BILL NO. BL2000-213

An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by changing from OR20 District to CS District properties at 617 and 619 Woodland Street, approximately 240 feet west of South 7th Street (.38 acres), (Proposal No. 2000Z-025U-05), all of which is more particularly described herein. The bill was disapproved by the Planning Commission. Ms. Beehan moved to withdraw the bill, with the understanding of property owner/petitioner Walter R. Owens that the bill is inappropriate and does not have the support of the Council nor the commercial interests in the neighborhood, which motion was seconded and adopted by a voice vote of the Council.

BILL NO. BL2000-215

An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by changing from R6 District to MUL District property at 106 Chapel Avenue, approximately 190 feet north of Eastland Avenue (.68 acres), (Proposal No. 2000Z-049U-05), all of which is more particularly described herein. The bill was disapproved by the Planning Commission. The bill was disapproved by the Planning Commission. Ms. Balthrop requested a hearing from the public on this bill which had been previously advertised. The President asked if anyone desired to be heard for or against the bill, and citizens were heard in favor of and in opposition to passage of the bill. The President declared the public hearing closed. Ms. Balthrop moved to pass the bill on second reading, which motion was seconded. Ms. Tucker moved to defer action indefinitely on the bill, which motion was seconded. After discussion Mr. Wallace called for the previous question, which motion was seconded and failed by a roll call vote of the Council. After further discussion, Mr. Ponder moved to table the motion to defer indefinitely, which motion was seconded and adopted by a voice vote of the Council. The matter recurred on the motion to pass on second reading and Ms. Balthrop’s request to defer the matter to the second regular meeting in November, which motion was seconded and adopted by a voice vote of the Council.

BILL NO. BL2000-374

An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by making applicable to property abutting the northwest corner of Springfield Highway and Tinnin Road, classified within the RS20 District (21.71 acres), the provisions of a Planned Unit Development District, to permit 30 single-family homes (Proposal No. 2000P-007G-02), all of which is more particularly described herein. BILL NO. BL2000-270

An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by changing from AR2a District to RS7.5 District a portion of property at Rural Hill Road (unnumbered), approximately 1,800 feet north of Mt. View Road (9.9 acres), (Proposal No. 2000Z-056U-13), all of which is more particularly described herein. Mr. Waters moved to call up this bill, to rescind previous action on second and third reading due to a technical error, and to re-advertise the bill for public hearing in November, which motion was seconded and adopted by a voice vote of the Council.
