ORDINANCE NO.BL2000-362

An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of the Metropolitan Government of Nashville and Davidson County, by amending Section 17.04.060 regarding the filing of a zone change application, all of which is more particularly described herein.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

SECTION 1. That Title 17 of the Code of Laws of The Metropolitan Government of Nashville and Davidson County, be and is hereby amended by making certain changes in the Official Zoning Map for Metropolitan Nashville and Davidson County, which is made a part of said Title 17 by reference, as follows:

By amending Section 17.04.060 (Amendments to Zoning Code or Official Zoning Map: Applications) by deleting and adding language as follows:

17.40.060 Applications.

An application to amend the official zoning map to apply a planned unit development or urban design overlay district shall be filed with the metropolitan planning commission. All other applications to amend the official zoning map or these zoning regulations shall be filed either with the planning commission or the metropolitan clerk. An application may be initiated by the property owner, the metropolitan planning commission, or a member of the metropolitan council.

SECTION 2. BE IT FURTHER ENACTED, That this ordinance take effect immediately after its passage and such change be published in a newspaper of general circulation, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.

Ordinance No. BL2000-362

Mr. President:

I move to amend Ordinance No. BL2000-362 by amending Section 1 by adding the following sentence at the end Section 17.40.060:

"An application to amend the official zoning map of property owned by the metropolitan government may be initiated only by the Mayor, the head of the department or agency to which the property is assigned, or by the director of public property administration."
