ORDINANCE NO. BL2000-409

An ordinance approving a Cooperative Agreement between the United States Department of the Army and The Metropolitan Government of Nashville and Davidson County, Department of Water and Sewerage Services, for the Dry Creek Wastewater Treatment Plant streambank protection project at Davidson County, Tennessee and authorizing all necessary officials to execute the same.

WHEREAS, the Metropolitan Government's Department of Water and Sewerage Services operates the Dry Creek Wastewater Treatment Plant on the Cumberland River in Davidson County, Tennessee; and

WHEREAS, the streambank at the Dry Creek Wastewater Treatment Plant property has eroded into the existing berm, lessening the flood protection of the facility; and

WHEREAS, the United States Department of the Army has authorization, in Section 14 of the Flood Control Act of 1946, as amended, 33 U.S.C.701r and Section 103(a) of the Water Resource Development Act of 1986, Public Law 99-662, amended, to cost share in the streambank protection project; and

WHEREAS, the project is included in Capital Budget No. 99SC0007.

NOW, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

SECTION 1: That the agreement between The United States Department of the Army and The Metropolitan Government, Department of Water and Sewerage Services, a copy of which is attached hereto and incorporated herein, is hereby approved and all necessary officials of The Metropolitan Government are authorized to execute the same.

SECTION 2: That any amendments, renewals or extensions of the terms of the agreement described in Section 1, or subsequent agreements at other sites to provide similar services beyond those contained therein shall be approved by Resolution of the Metropolitan Council.

SECTION 3: That this Ordinance shall take effect from and after its passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
