ORDINANCE NO. BL2000-420

An ordinance abandoning a 25-foot public utility and drainage easement between Kentucky Avenue and Alley # 1206, (Proposal No. 2000M-075U-07), all of which is more particularly described herein.

WHEREAS: It is the desire of all the abutting property owners that said abandonment be accomplished; and,

WHEREAS: There is no future need for said portion of said easement for Metropolitan Government purposes.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

SECTION 1. That certain 25-foot public utility drainage easement located at 5501 Kentucky Avenue and Alley #1206, classified within the R6 District (.29 acres), all of which is more particularly described by lines, words and figures on the sketch which is attached to and made a part of this ordinance as though copied herein, is hereby abandoned.

SECTION 2. BE IT FURTHER ENACTED, That this ordinance take effect from and after its passage,  the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.

AMENDMENT NO. 1

 TO

 ORDINANCE NO. BL2000-420

Mr. President:

 I move to amend Ordinance No. BL2000-420 as follows:

By deleting the period following the word "abandoned", replacing said period with a semicolon, and adding the following language:

"provided, however, that the existing sewer utility easement, extending ten feet on either side of the existing sewer line, shall be retained."
