ORDINANCE NO. BL2000-422

An ordinance to approve the granting of a permanent easement to Nashville Gas Company, a division of Piedmont Natural Gas Company, on certain property owned by the Metropolitan Government (Tax Map 103-7, Parcel 75) and presently used as the site of McCabe Golf Course.

WHEREAS, The Metropolitan Government of Nashville and Davidson County, owns certain property in Davidson County located on the south side of Murphy Road and used as the site of McCabe Golf Course (Tax Map 103-7, Parcel 75); and

WHEREAS, Nashville Gas Company desires to place a permanent easement (as depicted on the attached Exhibit A) on a portion of said property for the purposes of installing and maintaining a natural gas line; and

WHEREAS, the Board of Parks and Recreation has determined that the granting of this easement would not adversely affect the usage of said property and the Director of Public Property Administration has determined the value of said easement to be ten thousand, nine hundred and fifty dollars.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY, TENNESSEE:

SECTION 1. The granting of a permanent easement to Nashville Gas Company for the purpose of installing and maintaining a natural gas line (as depicted on the attached Exhibit A) on Tax Map 103-7, Parcel 75, is hereby approved.

SECTION 2. The Director of Public Property Administration, with the recommendation of the Board of Parks and Recreation, is hereby directed to grant said easement to Nashville Gas Company and is authorized to execute the necessary documents pertaining thereto.

SECTION 3. The proceeds of ten thousand, nine hundred and fifty dollars paid by Nashville Gas Company shall be credited to the general fund of the Metropolitan Government.

SECTION 4. This ordinance shall take effect from and after its adoption, the welfare of The Metropolitan Government of Nashville and Davidson County, Tennessee, requiring it.

Mr. President:

I move to amend Ordinance No. BL2000-422 by amending Section 2 by adding the following sentence:

"The Permanent Easement Agreement attached hereto as Exhibit "B" is hereby approved for execution by the Director of the Public Property Administration."
