Metropolitan Council Meeting

The Metropolitan Council met in regular session on this date at 7:00 p.m. in the Metropolitan Courthouse.
The invocation was offered by Reverend Paul Hancock of Goodlettsville Cumberland Presbyterian Church.
The Metropolitan Council gave the pledge of allegiance to the American Flag.

Nashville Airport Authority
Appointment of Mrs. Juli Mosley to the Metropolitan Nashville Airport Authority
for a term expiring April 6, 2006. The Rules-Confirmations-Public Elections
Committee recommended the appointment and Ms. Williams moved for confirmation,
which motion was seconded and adopted by a unanimous vote of the Council.
Appointment of Judge Gilbert Merritt to the Metropolitan Nashville Airport Authority for a term expiring June 4, 2006. The Rules-Confirmations-Public Elections Committee recommended the appointment and Ms. Williams moved for confirmation, which motion was seconded and adopted by a unanimous vote of the Council.
Board
of Equalization
Reappointment of Ms. Kathryn R. Barnett to the Board of Equalization for a term
expiring April 1, 2004. In the absence of the appointee, the appointment was
deferred.
Reappointment of Mr. James Clapper to the Board of Equalization for a term expiring April 1, 2004. The Rules-Confirmations-Public Elections Committee recommended the appointment and Ms. Williams moved for confirmation, which motion was seconded and adopted by a unanimous vote of the Council.

Planning Commission
Appointment of Ms. Gwen Hopkins to the Metropolitan Planning Commission for
a term expiring March 31, 2006. In the absence of the appointee, the appointment
was deferred.
Transportation
Licensing Commission
Reappointment of Mr. Carey Rogers to the Transportation Licensing Commission
for a term expiring April 30, 2004. The Rules-Confirmations-Public Elections
Committee recommended the appointment, and Ms. Williams moved for confirmation,
which motion was seconded and adopted by a unanimous vote of the Council.
- BILLS ON PUBLIC HEARING -
An ordinance adopting the Capital Improvements Budget and Program 2002-2003 through 2007-2008 for The Metropolitan Government of Nashville and Davidson County as the official Capital Improvements Budget and Program of The Metropolitan Government of Nashville and Davidson County for Fiscal Year 2002-2003. The bill was approved by the Planning Commission, Budget and Finance and Planning, Zoning and Historical Committees. Mr. Shulman requested a hearing from the public on this bill which had been previously advertised. The President asked if anyone desired to be heard for or against the bill, and no one came forward to be heard. The President declared the public hearing closed. Mr. Shulman moved to pass the bill on second reading and re-refer it to the Budget and Finance Committee, which motion was seconded and adopted by a voice vote of the Council.
An ordinance approving Amendment No. 2 to the Arts Center Redevelopment Plan. The bill was approved by the Planning Commission and Planning, Zoning and Historical Committee; the Federal Grants Review Committee recommended deferment. Mr. Wallace requested a hearing from the public on this bill which had been previously advertised. The President asked if anyone desired to be heard for or against the bill, and a citizen was heard in favor of passage of the bill. The President declared the public hearing closed. Mr. Wallace moved to defer action on the bill, upon the committee recommendation, which motion was seconded and adopted by a voice vote of the Council.
- RESOLUTIONS -
A resolution requesting the Metropolitan Planning Commission to revise its subdivision regulations relative to mandatory sidewalk construction. The resolution was approved by the Planning, Zoning, and Historical Committee. Mr. Black moved to defer action indefinitely on the resolution while an on-going sidewalk study is being completed, which motion was seconded and adopted by a voice vote of the Council.
RESOLUTION NO. RS2002-993
A resolution endorsing the 2002 Update Plan for the North Nashville Community adopted by the Metropolitan Planning Commission on January 24, 2002. Mr. Haddox offered a substitute resolution and moved that it be accepted for filing, and no objection was heard.

A resolution approving the property on Centennial Boulevard to be used for a waste transfer station. A resolution requesting the Metropolitan Police Department and the Davidson County General Sessions Courts to enforce state laws on littering and illegal dumping. A resolution requesting the Davidson County Delegation to the Tennessee General Assembly to oppose the adoption of an income tax in the State of Tennessee. A resolution requesting the Metropolitan Police Department and the Davidson County General Sessions Courts to enforce the Metropolitan Code provisions prohibiting excessive noise. A resolution appropriating to certain accounts for the benefit of the Fire Department the amount of Nine Hundred Nineteen Thousand, Four Hundred Nineteen Dollars ($919,419) from undesignated fund balances of the General Fund of the Urban Services District. A resolution establishing a blood alcohol concentration test fee upon the conviction of driving while intoxicated and such fee is not to exceed fifty dollars ($50). A resolution approving a cooperative agreement and an assistance amendment from the United States Environmental Protection Agency to the Metropolitan Government, acting by and through the Metropolitan Health Department, for a total amount not to exceed $750,433.00 for planning, developing, establishing, improving and implementing national primary and secondary air quality standards, with a match of local funds not to exceed $290,556.00. A resolution approving an Amendment No. 2 to the Contract, which amendment increases the grant to an amount not to exceed $379,000 from the State of Tennessee, Department of Agriculture, to The Metropolitan Government of Nashville and Davidson County, acting through the Metropolitan Board of Health, for the inspection, reporting and enforcement of retail food stores in Davidson County, and which amendment also sets forth the obligations of the State to the Metropolitan Government and the payment methodology. An ordinance authorizing the acquisition of property by negotiation or condemnation for use in a public project for The Metropolitan Government of Nashville and Davidson County and specifically with relation to the construction of the I. T. Creswell Elementary School to be located in the Pearl-Cohn Cluster in the 40th Avenue North and Clifton Avenue area. Upon motion duly seconded, the bill passed first reading and was referred to the Planning Commission, Budget and Finance, Education and Planning, Zoning and Historical Committees by a voice vote of the Council.
An ordinance approving a grant from the State of Tennessee, Tennessee Historical Commission, to The Metropolitan Government of Nashville and Davidson County, acting through the Metropolitan Historical Commission, for funds to send two or more members of the Metropolitan Historic Zoning Commission, or staff of the Metropolitan Historical Commission, to attend the 2002 National Alliance of Preservation Commissions (NAPC) Forum, held August 1-4, 2002, in San Antonio, Texas. An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by changing from RS40 District and CN District to CL District property at Highway 100 (unnumbered), (6.44 acres), all of which is more particularly described herein (Proposal No. 2001Z-112G-06). An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by changing from RS7.5 District to CS District a portion of property at 2223 Whites Creek Pike, at the intersection of Whites Creek Pike and Toney Road, (8.79 acres), all of which is more particularly described herein (Proposal No. 2002Z-028U-03).
