ORDINANCE NO. BL2002-1083

An ordinance amending Title 17 of the Metropolitan Code of Laws, the Zoning Code of the Metropolitan Government of Nashville and Davidson County, by making applicable to various parcels and portions of parcels in Green Hills along Hillsboro Circle, Bandywood Drive, Hillsboro Drive, Hobbs Road, Warfield Drive, Hillsboro Pike, Abbott Martin Road and Richard Jones Road (80.9 acres), classified SCR, OR20 and RM20 districts, the provisions of the Urban Design Overlay District, (Proposal No. 2002UD-001U-10), all of which is more particularly described herein.

WHEREAS, the Green Hills Urban Village Plan endorsed by the Metropolitan Planning Commission in 1999 recommends the use of the Urban Design Overlay district to create an urban village atmosphere in Green Hills, and

WHEREAS, pursuant to Section 17.36.270 of the Zoning Regulations, design goals and objectives for the designated area have been set forth, thereby establishing the eligibility of this area for the application of the Urban Design Overlay district; and

WHEREAS, Planning Department staff and consultants retained by the Metropolitan Planning Commission worked closely with groups and individuals with a wide range of interests in Green Hills to prepare a design plan and associated design guidelines, entitled Green Hills UDO Design Guidelines [the Guidelines], to implement the goals and objectives set forth pursuant to Section 17.36.270 of the Zoning Regulations;

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. THAT IT IS HEREBY FOUND AND DETERMINED that the area proposed for the application of the Urban Design Overlay district is eligible for said application, and that the proposal otherwise conforms to the General Plan for Nashville.

Section 2. BE IT FURTHER ENACTED, That Title 17 of the Code of Laws of The Metropolitan Government of Nashville and Davidson County, be and is hereby amended by making certain changes in the Official Zoning Map for Metropolitan Nashville and Davidson County, which is made a part of said Title 17 by reference, as follows:
By applying an Urban Design Overlay District to various parcels and portions of parcels in Green Hills along Hillsboro Circle, Bandywood Drive, Hillsboro Drive, Hobbs Road, Warfield Drive, Hillsboro Pike, Abbott Martin Road, and Richard Jones Road (80.9 acres), being more particularly described as being various parcels as designated on Maps 117 and 131 of the Official Property Identification Maps of The Metropolitan Government of Nashville and Davidson County, all of which is more particularly described on Exhibit 1 entitled " Properties Included In The Hillsboro Village Urban Design Overlay District" and Exhibit 2 entitled "Green Hills UDO Design Guidelines," consisting of text, tables, maps and other graphics, and an appendix, all of which are attached to and made a part of this ordinance as though copied herein, all dated May 23, 2002, as filed with the Metropolitan Clerk.

SECTION 3. BE IT FURTHER ENACTED, That the Metropolitan Clerk is hereby authorized and directed, upon the enactment and approval of this ordinance, to cause the change to be made on Sheet Nos. 117 and 131 of said Official Zoning Map for Metropolitan Nashville and Davidson County, as set out in Section 1 of this ordinance, and to make notation thereon of reference to the date of passage and approval of this amendatory ordinance.

SECTION 4. BE IT FURTHER ENACTED, That this ordinance take effect immediately after its passage and such change be published in a newspaper of general circulation, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.

SECTION 5. BE IT FURTHER ENACTED, That the Metropolitan Clerk is directed to file this Ordinance together with the Guidelines referred to herein as a part of the minutes of this meeting.
