ORDINANCE NO. BL2002-1092

An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by applying an Urban Design Overlay District to properties abutting the northeast margin of Bellevue Road and the northwest margin of Old Harding Pike, classified CL and proposed for MUL, (5.76 acres), to permit a mixed-use development including 61,850 square feet of retail/restaurant/office/residential uses, (Proposal No. 2002UD-002G-06).

WHEREAS, pursuant to Section 17.36.270 of the Zoning Regulations, design goals and objectives for the designated area have been set forth, thereby establishing the eligibility of this area for the application of the Urban Design Overlay district; and

WHEREAS, Planning Department staff worked closely with groups and individuals with a wide range of interests in the Bellevue area to prepare a design plan and associated design guidelines, entitled Bellevue Town Center Urban Design Guidelines [the Guidelines], to implement the goals and objectives set forth pursuant to Section 17.36.270 of the Zoning Regulations;

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. THAT IT IS HEREBY FOUND AND DETERMINED that the area proposed for the application of the Urban Design Overlay district is eligible for said application, and that the proposal otherwise conforms to the General Plan for Nashville.

Section 2. That Title 17 of the Code of Laws of The Metropolitan Government of Nashville and Davidson County, be and is hereby amended by making certain changes in the Official Zoning Map for Metropolitan Nashville and Davidson County, which is made a part of said Title 17 by reference, as follows:

By applying an Urban Design Overlay District to properties abutting the northeast margin of Bellevue Road and the northwest margin of Old Harding Pike, classified CL and proposed for MUL, (5.76 acres), to permit a mixed-use development including 61,850 square feet of retail/restaurant/office/residential uses, as being Property Parcel Nos. 38, 39 and 42 as designated on Map 142 of the Official Property Identification Maps of The Metropolitan Government of Nashville and Davidson County, all of which is more particularly described by the attached sketch which shows the properties to be included in the "Bellevue Town Center Urban Design Overlay District, Exhibit A entitled "Bellevue Town Center Urban Design Guidelines" consisting of text, tables, maps and other graphics, lines, words and figures on the attached conceptual plan, which is attached to and made a part of this ordinance as though copied herein.

Section 2. BE IT FURTHER ENACTED, That the Metropolitan Clerk is hereby authorized and directed, upon the enactment and approval of this ordinance, to cause the change to be made on Sheet No. 142 of said Official Zoning Map for Metropolitan Nashville and Davidson County, as set out in Section 1 of this ordinance, and to make notation thereon of reference to the date of passage and approval of this amendatory ordinance.

Section 3. BE IT FURTHER ENACTED, That this ordinance take effect immediately after its passage and such change be published in a newspaper of general circulation, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.

SUBSTITUTE ORDINANCE NO. BL2002-1092

Mr. President:

I move to amend Substitute Ordinance No. BL2002-1092 as follows:

By amending Section 2 by deleting Exhibit A entitled "Bellevue Town Center Urban Design Guidelines" and substituting in lieu thereof the attached Exhibit A entitled "Bellevue Town Center Urban Design Guidelines".
