ORDINANCE NO. BL2002-1076

An ordinance authorizing the acquisition of property by negotiation or condemnation for use in a public project for The Metropolitan Government of Nashville and Davidson County and specifically with relation to the construction of the I. T. Creswell Elementary School to be located in the Pearl-Cohn Cluster in the 40th Avenue N and Clifton Avenue area.

WHEREAS, Section 2.01 (5) of the Charter of The Metropolitan Government of Nashville and Davidson County grants to such government to power to "…purchase…or otherwise acquire…property…for any public purpose"; and

WHEREAS, Section 2.01 (6) of the Charter of The Metropolitan Government of Nashville and Davidson County authorizes the government "to establish, maintain and regulate…a system of free schools…"; and

WHEREAS, it is in the public interest that certain property, identified on Tax Map 91-8 as Parcels 304, 304.01, 306, 307, 324, 308, 309, 310, 331, 311, 312, 313, 314, 315, 316, 317, 318, 319, 320; and on Tax Map 92-12 as Parcels 190, 191, 192, 193, 197, 198, 199, 301, 200, 201, 202, 203, 204, 205, 206, 207, and 208, be acquired through negotiation or condemnation for the construction of the new I. T. Creswell Elementary School.

WHEREAS, the Metropolitan Board of Education approved the acquisition of said property at its meeting on August 14, 2001.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. The Director of Public Property Administration, or his designee, is hereby authorized to acquire, by negotiation or condemnation, property for the purpose of constructing, maintaining and operating the new I. T. Creswell Elementary School.

Section 2. The Director of Public Property Administration, or his designee is hereby authorized and directed, if necessary to take and appropriate by condemnation proceedings the property shown on Exhibit A and identified on Tax Map 91-8 as Parcels 304, 304.01, 306, 307, 324, 308, 309, 310, 331, 311, 312, 313, 314, 315, 316, 317, 318, 319, 320; and on Tax Map 92-12 as Parcels 190, 191, 192, 193, 197, 198, 199, 301, 200, 201, 202, 203, 204, 205, 206, 207, and 208.

Section 3. This ordinance shall take effect from and after its passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.

AMENDMENT NO.1

TO

ORDINANCE NO. BL2002-1076

Mr. President:

I move to amend Ordinance No. BL2002-1076 by amending the third paragraph and Section 2 by replacing the reference to "Tax Map 92-12" with "Tax Map 91-12".
