RESOLUTION NO. RS2002-1040

A resolution requesting the Metropolitan Police Department and the Davidson County General Sessions Courts to enforce state laws on littering and illegal dumping.

WHEREAS, due to a decision by the Supreme Court of Tennessee, violations of Metro Government ordinances generally carry a fine of $50.00 maximum; and

WHEREAS, littering and illegal dumping continue to plaque our community; and

WHEREAS, Tennessee State law provides for a penalty of up to $500.00 for such activities; and

WHEREAS, to discourage littering and illegal dumping, it would be appropriate that the Metropolitan Police Department cite violators for state laws rather than Metro violations, and that the courts impose significant fines under the state law.

NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

SECTION 1. That the Metropolitan County Council hereby goes on record as requesting the Metropolitan Police Department and the Davidson County General Sessions Court to enforce state laws on littering and illegal dumping.

SECTION 2. The Metropolitan Clerk is directed to send a certified copy of this Resolution to the Chief of Police and to the Presiding Judge of the General Sessions Courts.

SECTION 3. This Resolution shall take effect from and after its adoption, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
