ORDINANCE NO. BL2002-1067

An ordinance approving a lease agreement between The Metropolitan Government of Nashville and Davidson County and the American Trust Building, LLC for office space for the Office of the Metropolitan Public Defender (2002M-038U-09).

Whereas, the American Trust Building, LLC, owns certain real property known as the American Trust Building, located at 3rd Avenue North and Union Street; and

Whereas, The Metropolitan Government has determined that this property is needed to provide office space for the Metropolitan Public Defender; and

Whereas, The Metropolitan Government and the American Trust Building, LLC, have negotiated the attached lease/purchase agreement for a lease term beginning July 1, 2002 and ending June 30, 2012; and

Whereas, the Director of Public Property Administration is authorized to lease real property, subject to the approval of the Metropolitan County Council and Mayor.

Now, therefore, be it enacted by the Metropolitan Council of The Metropolitan Government of Nashville and Davidson County:

Section 1. The Director of Public Property Administration is hereby authorized to lease the said property listed above from the American Trust Building, LLC, in accordance with the attached agreement.

Section 2. The costs of this lease shall be paid out of the General Fund 10101 fund.

Section 3. That any amendments to this lease shall be approved by resolution of the Metropolitan Council receiving twenty-one affirmative votes.

Section 4. This ordinance shall take effect from and after its passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
