ORDINANCE NO. BL2002-1040

An ordinance approving a lease agreement between Neal and Oleta Shipper and The Metropolitan Government of Nashville and Davidson County, acting by and through the Nashville Career Advancement Center, for the premises located at 813A North Cumberland Drive, Lebanon, TN 37087 located in Wilson County (2002M-036G-00).

WHEREAS, Neal and Oleta Shipper own certain real property located at 813A North Cumberland Drive, County of Wilson, Lebanon, Tennessee, 37087, and that they and the Metropolitan Government have negotiated the attached lease agreement; and,

WHEREAS, the Nashville Career Advancement Center (NCAC) is the local fiscal agent and administrator of federal funds allocated to the Middle Tennessee Local Workforce Investment Area under the Workforce Investment Act and Families First Program; and,

WHEREAS, The Middle Tennessee Local Workforce Investment Area is comprised of Davidson, Rutherford, Trousdale and Wilson counties and that NCAC serves dislocated workers, Families First, Welfare to Work, working poor, and the general public; and,

WHEREAS, the Metropolitan Government has determined that the aforesaid property is needed to provide space for office and classroom space for the Nashville Career Advancement Center; and,

WHEREAS, the Director of Public Property Administration is authorized to lease real property, subject to the approval of the Metropolitan County Council and Mayor.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY, TENNESSEE:

SECTION 1. The Lease Agreement between The Metropolitan Government of Nashville and Davidson County, acting by and through the Nashville Career Advancement Center, and Neal and Oleta Shipper for rental in an amount not to exceed $2,062.50 per month and for a term beginning on April 1, 2002 and ending on March 31, 2007, a copy of which is attached hereto and incorporated herein, be and the same is hereby approved.

SECTION 2. The rent shall be paid out of the Fund 31000 fund.

SECTION 3. That any amendments to this Lease Agreement shall be approved by resolution of the Metropolitan Council receiving twenty one affirmative votes.

SECTION 4. This ordinance shall take effect from and after its passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
