RESOLUTION NO. RS2002-1003

A resolution requesting the Stormwater Management Committee to adopt changes to its regulations to provide for notice of public hearings and consideration on developments in floodway and floodplain areas.

WHEREAS, the Stormwater Management Committee, under the Metropolitan Code, has the authority to adopt regulations which govern the approval process of development in floodplains; and

WHEREAS, in order to improve regulation of developments in floodways and floodplains, it is appropriate that the Stormwater Management Committee give notice to affected neighborhoods, and the district council member of the proposed development in a floodplain or floodway area, and that they conduct public hearings giving opportunity for citizens to have input into the decision as to whether the subject development is approved.

NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

SECTION 1. That the Metropolitan County Council hereby goes on record as requesting the Stormwater Management Committee to adopt changes to its regulations to provide for notice of public hearings and consideration on developments in floodway and floodplain areas. Such amendments to the regulations should include that notice be given to affected neighborhoods, the district council member, the staff of the Metropolitan Board of Public Education, and that a public hearing be held after such notice to allow citizens to have input into the approval process for such development. Further, the Stormwater Management Committee should give great weight and due consideration to citizen concerns and input from other agencies of the Metropolitan Government whose services may be impacted by any proposed floodplain development.

SECTION 2. That the Metropolitan Clerk is directed to send a certified copy of this Resolution to the Acting Director of the Metro Public Works Department and to each member of the Stormwater Management Committee.

SECTION 3. That the Acting Director of the Public Works Department and members of the Stormwater Management Committee are further requested to inform The Metropolitan Council of the feasibility and/or the actions taken in compliance with the request contained in Section 1 thereof, not later than sixty (60) days after the adoption of this Resolution.

SECTION 4. That this Resolution shall take effect from and after its adoption, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
