ORDINANCE NO. BL2002-1085

An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by applying a Planned Unit Development to property abutting the north margin of Highway 100, and the south margin of Old Harding Pike, classified within the CN and RS40 districts and proposed for CL district, (6.44 acres), to permit the development of a 14,560 square foot retail drug store, an 11,000 square foot retail/restaurant building, and a 6,500 square foot retail building, a public street connection between Highway 100 and Old Harding Pike, and approximately three-quarters of an acre as open space, all of which is more particularly described herein (Proposal No. 2000P-005G-06).

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. That Title 17 of the Code of Laws of The Metropolitan Government of Nashville and Davidson County, be and is hereby amended by making certain changes in the Official Zoning Map for Metropolitan Nashville and Davidson County, which is made a part of said Title 17 by reference, as follows:

By applying a Planned Unit Development to property abutting the north margin of Highway 100, and the south margin of Old Harding Pike, classified within the CN and RS40 districts and proposed for CL district, (6.44 acres), to permit the development of a 14,560 square foot retail drug store, an 11,000 square foot retail/restaurant building, and a 6,500 square foot retail building, a public street connection between Highway 100 and Old Harding Pike, and approximately three-quarters of an acre as open space, as being Property Parcel No. 113 as designated on Map 155 of the Official Property Identification Maps of The Metropolitan Government of Nashville and Davidson County, all of which is more particularly described by lines, words and figures on the attached conceptual plan, which is attached to and made a part of this ordinance as though copied herein.

Section 2. BE IT FURTHER ENACTED, That the Metropolitan Clerk is hereby authorized and directed, upon the enactment and approval of this ordinance, to cause the change to be made on Sheet No. 155 of said Official Zoning Map for Metropolitan Nashville and Davidson County, as set out in Section 1 of this ordinance, and to make notation thereon of reference to the date of passage and approval of this amendatory ordinance.

Section 3. BE IT FURTHER ENACTED, That this ordinance take effect immediately after its passage and such change be published in a newspaper of general circulation, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.

Mr. President:

I move to amend PUD Ordinance No. BL2002-1085 as follows:

Replace page C1.03 of the plan with new page C1.03.

All buildings within the PUD shall be constructed with a red brick exterior matching the Walgreen’s at Baker’s Bridge at Cool Springs, Franklin, Tennessee.

Any ground signs within this PUD, other than the Walgreen’s sign that shall have a maximum of 14 feet, shall have a maximum height of no more than 8 feet.
