SUBSTITUTE ORDINANCE NO. BL2002- 1039
A substitute ordinance authorizing the transfer of the administrative support for the Caring for Children's Program from the Metropolitan Social Services Commission to the Department of Finance and approving the Memorandum of Agreement between the Davidson County Community Service Agency and The Metropolitan Government of Nashville and Davidson County for funding of the administration of the Caring for Children's Program.
Whereas, the Davidson County
Community Service Agency ("DCCSA") is a public entity created and
existing under authority of Title 37, Chapter 5, Part 3 of Tennessee Code Annotated
has entered into a grant agreement with the State of Tennessee, Department of
Children's Services for the funding of the Caring for Children's Program; and
Whereas, the DCCSA has entered
into an agreement with The Metropolitan Government of Nashville and Davidson
County (Metropolitan Government) for funding to administer the services of the
Caring for Children's Program, including, but not limited to, case management,
reunification, emergency residential and administrative services; and
Whereas, effective July 1, 1997, the administrative support for the Caring for Children's Program was transferred from the Metropolitan Department of Health to the Metropolitan Social Services Commission and such transfer was approved by Bill No. 097-854; and
Whereas, it has been determined
that the administrative support for the Caring For Children's Program would
be more effective if transferred to the Department of Finance; and
Whereas, it is deemed to
be in the best interest of the Metropolitan Government to approve the transfer
of the administrative support for the Caring for Children's Program from the
Metropolitan Social Services Commission to the Department of Finance and to
approve the agreement between Metro and DCCSA for funding to provide such services.
Now, therefore, be it enacted
by the Metropolitan Council of The Metropolitan Government of Nashville and
Davidson County:
Section 1. That the Board of the Caring for Children Program established pursuant state law will continue to exercise all of the responsibilities established by law as to said program, making policy decisions and executing all substantive policy oversight pursuant to its responsibility under state law.
Section 2. That the transfer
of the administrative support for the Caring for Children's Program from the
Metropolitan Social Services Commission to the Department of Finance is hereby
approved.
Section 3. That the Memorandum
of Agreement between the DCCSA and the Metropolitan Government for funding of
the administration of the Caring for Children's Program, a copy of which is
attached hereto and incorporated herein, is hereby approved.
Section 4. That any amendments
to this ordinance shall be approved by resolution of the Metropolitan Council
receiving twenty-one (21) affirmative votes.
Section 5. That this ordinance shall take effect from and after its final passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
