ORDINANCE NO. BL2002-1070

An ordinance abandoning the water line and easement on Map 131-06-A, Parcel 017 of Project No. 01-SL-133, Burton Hills IV Water Line and Easement Abandonment (Proposal No. 2002M-026U-10), District 33.

WHEREAS, Burton Hills IV, is the owner of real property encumbered by a water line and easement; and,

WHEREAS, a new water line has been installed which adequately serves the lots and the neighboring properties; and,

WHEREAS, the water line and easement are no longer being used by the Department of Water and Sewerage Services, more particularly described on the plans for Project No. 01-SL-133, Burton Hills IV Water Line and Easement Abandonment, on record in the office of the Director of Water and Sewerage Services, said plans are made a part hereof as though copied herein; and,

WHEREAS, the Department of Water and Sewerage Services has no need for the said easement; and,

WHEREAS, The Metropolitan Planning Commission of Nashville and Davidson County has already approved the abandonment of said easement.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

SECTION 1: That the water line and easement shown on Map Map 131-06-A, Parcel 017, and shown on Project No. 01-SL-133, Burton Hills IV Water Line and Easement Abandonment, are declared abandoned, and the below signed are hereby authorized to execute the appropriate instruments to carry out such abandonment.

SECTION 2: That this ordinance take effect from and after its passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.

SECTION 3. Any further amendments to this legislation may be processed by resolution.
